This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.

The Universal Declaration of Human Rights (UDHR) is the best gift of the United Nations and its main human rights organ, the Human Rights Commission to “We, the Peoples of the World”. But that powerful instrument is often rendered powerless by the behaviour of individuals running the institutions and the states, arguably the most powerful institution conceptualised by human mind so far. In the process, the UN comes under serious criticism and its most important organ which helped give the UDHR was dissolved for “failing to live up to its ideals”. Ironically, the same states and their representatives most instrumental in creating the UN institutions, including the Human Rights Commission first but later vilifying it and leading the campaign for its replacement by the Human Rights Council are now once again attacking it as “hypocritical and self-serving organisation that makes a mockery of human rights” and the most powerful member state feels compelled to walk out of the Council. Where does the world, the UN and “we the peoples” stand in the search for greater freedom from want and fear, better enjoyment of dignity and rights? Travelling through an extraordinary journey of life, academic pursuits and expeditions of professional and diplomatic mountain climbing, including the Chairmanship of the 56th Session of the UN Commission on Human Rights and its 5th Special Session on the Human Rights of the Palestinian People in the Occupied Palestine Territories, Shambhu Ram Simkhada presents a scholarly, diplomatic, advocate and defender perspectives on the contemporary state of human rights and human wrongs in the scale of his own human conscience. Please note: Taylor & Francis does not sell or distribute the Hardback in India, Pakistan, Nepal, Bhutan, Bangladesh and Sri Lanka.

Fifteen countries have emerged from the collapse of the Soviet Union. Freedom's Ordeal recounts the struggles of these newly independent nations to achieve freedom and to establish support for fundamental human rights. Although history has shown that states emerging from collapsed empires rarely achieve full democracy in their first try, Peter Juviler analyzes these successor states as crucial and not always unpromising tests of democracy's viability in postcommunist countries. Taking into account the particularly difficult legacies of Soviet communism, Freedom's Ordeal is distinguished by its careful tracing of the historical background, with special attention to human rights before, during, and after communism. Juviler suggests that the culture and practices of despotism may wither wherever modernization conflicts with tyranny and with the curtailment or denial of democratic rights and freedoms.
