Increasingly, European and other Western states have sought to control the movement of refugees outside their borders. To do this, states have adopted a variety of measures - including carrier sanctions, interception of migrants at sea, posting of immigration officers in foreign countries and external processing of asylum-seekers. This book focuses on the legal implications of external mechanisms of migration control for the protection of refugees and irregular migrants. The book explores how refugee and human rights law has responded to the new measures adopted by states, and how states have sought cooperation with other actors in the context of migration control. The book defends the thesis that when European states attempt to control the movement of migrants outside their territories, they remain responsible under international law for protecting the rights of refugees as well as their general human rights. It also identifies how EU law governs and constrains the various types of pre-border migration enforcement employed by EU Member States, and examines how unfolding practices of external migration control conform with international law. This is a work which will be essential reading for scholars and practitioners of asylum and refugee law throughout Europe and the wider world. As migration has not commonly been considered as part of the indigenous experience, the prevalent view of indigenous communities tends to portray them as static groups, deeply rooted in their territories and customs. Increasingly, however, indigenous peoples are leaving their long-held territories as part of the phenomenon of global migration beyond the customary seasonal and cultural movements of particular groups. Fran�ois Hartog explores crucial moments of change in societyÕs Òregimes of historicityÓ or its way of relating to the past, present, and future. Inspired by Arendt, Koselleck, and Ricoeur, Hartog analyzes a broad range of texts, positioning the The Odyssey as a work on the threshold of a historical consciousness and then contrasting it against an investigation of the anthropologist Marshall SahlinsÕs concept of Òheroic history.Ó He tracks changing perspectives on time in Ch‰teaubriandÕs Historical Essay and Travels in America, and sets them alongside other writings from the French Revolution. He revisits the insight of the French Annals School and situates Pierre NoraÕs Realms of Memory within a history of heritage and our contemporary presentism. Our presentist present is by no means uniform or clear-cut, and it is experienced very differently depending on oneÕs position in society. There are flows and acceleration, but also what the sociologist Robert Castel calls the Òstatus of casual workers,Ó whose present is languishing before their very eyes and who have no past except in a complicated way (especially in the case of immigrants, exiles, and migrants) and no real future (since the temporality of plans and projects is denied them). Presentism is therefore experienced as either emancipation or enclosure, in some cases with ever greater speed and mobility and in others by living from hand to mouth in a stagnating present. Hartog also accounts for the fact that the future is perceived as a threat and not a promise. We live in a time of catastrophe, one he feels we have brought upon ourselves.
