In 1994, artistic freedom pertaining inter alia to literature was enshrined in the South African Constitution. Clearly, the establishment of this right was long overdue compared to other nations within the Commonwealth. Indeed, the legal framework and practices regarding the regulation of literature that were introduced following the nation’s transition to a non-racial democracy seemed to form a decisive turning point in the history of South African censorship of literature. This study employs a historical sociological point of view to describe how the nation’s emerging literary field helped pave the way for the constitutional entrenchment of this right in 1994. On the basis of institutional and poetological analyses of all the legal trials concerning literature that were held in South Africa during the period 1910–2010, it describes how the battles fought in and around the courts between literary, judicial and executive elites eventually led to a constitutional exceptio artis for literature. As the South African judiciary displayed an ongoing orientation towards both English and American law in this period, the analyses are firmly placed in the context of developments occurring concurrently in these two legal systems.

In the 1950s, civic society in South Africa became mobilized against racist laws that penetrated nearly every aspect of civic life. The social justice struggle that eventually displaced white minority rule culminated in democratic elections in 1994. Following this historic transition from authoritarian rule to democracy, other issues came to the fore, including how the government was to receive persons claiming refugee status on the basis of persecution and war. Civic actors in South Africa again became mobilized around these 'new' human rights and social justice issues. At different moments, civic actors became engaged either in working with the government to develop a refugee policy, or in confronting the government to fulfill its national and international obligations towards refugees. This book discusses the dynamics of civic-state interactions aimed at the state's obligations to promote, protect, and fulfill human rights. Through the lens of refugee rights advocacy in South Africa, in the first decade of its post-1994 period of democracy, this book examines and explains the circumstances under which civic-state interactions can lead to structural change, and what these interactions can teach us about the potential of civic society to realize rights in general.

The main thesis of this book is that, given that South African education faces major challenges, the BRICS (Brazil, Russia, India, China and South Africa) constellation of states offers — thus far overlooked — a valuable tertium comparationis, a source of international comparative perspectives, to inform the domestic scholarly discourse on education. This book first investigates the national contexts and development of education in the BRICS countries, arguing that this grouping represents a valuable but yet overlooked field for illuminating South African education issues with international perspectives. The book consists of chapters arguing for and illustrating this thesis from a variety of angles. Common to all chapters is that authors used the comparative method in education, that is comparing the national education system, in their education societal context interrelationships, of the BRICS countries. The chapters focus on a number of critical issues in South African education, including the language of learning and teaching issue, the alignment of the world of education with the world of work, early childhood education, and the development of world-class universities. Regarding the last, for example, China has been the terrain of the most intensive national projects of establishing world-class universities, with Project 985, Project 211, and the “Double First Class University” project. The chapters demonstrate what South Africa, in approaching her education issues, can learn from the experience of the BRICS countries.
