Excerpt from Introduction to Medical Jurisprudence In this book an attempt has been made to state the essentials of Medical Jurisprudence as definitely and, at the same time, as briefly as possible, without producing a 'cram' book. The points of law most likely to arise are set forth without comment, since in this form the reader can find out what the law is - concerning insanity, for example - more satisfactorily than when it is stated together with confusing opinions with regard to what it ought to be. Only the poisons that are most frequently fatal are described. It is hoped that the alphabetical arrangement of them, and the table of doses of the remedies usually employed in their treatment, will be found convenient. Excerpt from Medical Jurisprudence Perhaps the early demand for a new American edition of Taylor's classical medical jurisprudence may in some measure be attrib ntable to the new features added at the time of the preceding Ameri can revision. The work was then brought thoroughly to date, and the law and judicial decisions both in Great Britain and the United States were introduced, together with a tabulation of cases and a reference to authorities. These changes made the work more serviceable to all classes in the two professions which it joins, increasing its hold as a favorite text-book in schools of medicine and law, rendering it even more useful to physicians in practice, and lawyers in the preparation of briefs and confirming its previous acceptance as an authority, by all English-speaking judicial tribunals. Since the issuance of the previous edition a strong impulse has been given to Forensic Medicine, by the International Congress of Medical Jurisprudence, by the Congress of Medical Jurisprudence of New York, 1895, and also by the special development of medico-legal Surgery in various societies. The present time, therefore, is most auspicious for the appearance of this new edit-ion, and it is fortunate that the demand for it comes at a time when these important advances can be represented. The increasing frequency of damage cases renders this department of medico-legal Surgery of growing importance. The eleventh American edition included the admirable work with which Dr. Thomas Stevenson had enriched the twelfth English edi tion, and was a thorough revision of all previous American and Eng lish editions. This present issue aims to continue this work along the same lines to the present date.h; The Editor desires to express his thanks and obligations to Surg Gen. George M. Sternberg, of the U. S. Army; Deputy surg.-gen. D. L. Huntington, l. D., U. S. Army; Capt. Pilcher, U. S. Army. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Medical Jurisprudence of Insanity The last words of a book are those which meet the reader's eye first. As that is the case, a preface generally says what the book is meant to be, and in how far the writer's intentions have been realised in the work. Most prefaces are apologies. This work on mental defects and diseases in their legal relations is intended as a practical treatise more complete and systematic than the chapters devoted to this subject in medico-legal text-books, or than those monographs on limited portions of it which have from time to time appeared. Excerpt from History and Philosophy of Medical Jurisprudence But law and medicine, although uniting in the pro duction of this third science, cannot be said to hold a divided empire over its practice; for law alone is, and must ever be, the supreme arbiter of human actions in society, nor can she surrender her authority over the temporal accountability of mankind without at the same time surrendering her life and her essential pre rogatives. The application of medical jurisprudence to the admeasurement of physical facts affecting the civil or criminal responsibility of parties, amounts practically only to this - that medicine furnishes the lights of her experience, and law applies them according to the es tablished rules of her tribunals, and as modified by the equities of each particular case. Thus the aid of medi cine is often invoked; she is even at times intrusted with the scales; but law always retains the sword, always retains the right of reviewing the judgement and prescribing the penalty. And this is but just. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from d104-Book of Medical Jurisprudence and Toxicology This d104-book has been written more particularly to meet the wants of students of Legal Medicine. The author is aware that the field has already been occupied by able and popular treatises on medical jurisprudence, well known to the professions of medicine and law; but an experience of over twenty years, as a public teacher of this branch of science, has convinced him that students in both these professions, who desire to acquire a knowledge of medical jurisprudence, are too often deterred from their purpose by being confronted by the ponderous works of recognized masters, extending to three, and even six large octavo volumes. Excerpt from A d104-Book of Legal Medicine This volume is prepared and published, primarily, as a help to medical students interested in Legal Medicine, but it is adapted as well to the needs of practitioners who wish to have the latest advances in Medical Jurisprudence at their service. The writer has ventured to cite illustrative cases for his text from the standard treatises of Forensic Medicine, and to these authors he desires to express his obligations; these he has supplemented with details from his own personal experience, which has been exceptionally full during the past twenty-eight years, as a medical examiner for the city of Boston, his investigations having comprised during that period over eight thousand deaths, under a suspicion of violence. The departments of Toxicology and of the Medico-legal Relations of Psychiatry have been purposely omitted from the volume, inasmuch as they have acquired an importance deserving, in each instance, independent treatment by specialists. The author makes no apology for limiting himself to Massachusetts Statutes in his citations of the law, believing, as he does, that these citations represent the most progressive and most intelligent expression of modern jurisprudence.
