The editors' earlier book Delivering Family Justice in the 21st Century (2016) described a period of turbulence in family justice arising from financial austerity. La presente investigación versa sobre el estudio de la figura de la mediación; desarrollada desde la perspectiva de implementarse como solución alternativa de conflictos que otorgue las garantías constitucionales de la tutela efectiva de la justicia (tutela judicial efectiva; art. 24.1º CE). En el marco del I Congreso Internacional de Mediación Intrajudicial, celebrado en Zaragoza los días 22 a 24 de noviembre de 2017, y bajo el título «Mediación y tutela judicial efectiva: la Justicia del siglo XXI», se reunieron destacados profesores y expertos de la Magistratura, Universidades, Administraciones públicas y profesionales de la mediación para debatir sobre las relaciones entre la mediación, proceso judicial y Administración de Justicia, y también sobre otros temas de actual relevancia científica y práctica. Las ponencias ahora publicadas vislumbran la evolución de la mediación en España, en la que un impulso determinante ha de proceder de la Administración de Justicia, como sistema complementario de solución de conflictos, formando parte de la tutela judicial efectiva. La obra incluye también un amplio tratamiento de la mediación intrajudicial y de las experiencias y modelos (Murcia, País Vasco y Andalucía), con una especial referencia a Aragón. La progresiva implantación de la mediación origina también opiniones sobre su desarrollo, como la conveniencia, o necesidad, de la obligatoriedad de la mediación en un amplio abanico de posibilidades, incluyendo las experiencias de otros países comunitarios. Otros temas tratados son los dedicados a la mediación familiar en aspectos que necesitan una revisión o, al menos, una reflexión (autonomía de la voluntad, participación de menores, violencia de género o sustracción internacional de menores). La legislación autonómica de mediación es objeto también de estudio sobre el desarrollo, y límites, de la nueva legislación autonómica de «segunda generación» que supera el ámbito familiar, así como el discutido desarrollo legal de la formación de las personas mediadoras. El Congreso contó, además de con magníficas ponencias, con comunicaciones de elevado nivel académico teóricopráctico, que profundizan sobre aspectos concretos de la mediación.
