This is a book about jurisprudence—or legal philosophy. The legal philosophical texts under consideration are—to say the least—unorthodox. Tolkien, Buffy the Vampire Slayer, Harry Potter, Million Dollar Baby, and other cultural products are all referenced as exemplary instances of what the author calls lex populi—“people’s” or “pop law.” There, more than anywhere else, will one find the leading issues of legal philosophy. These issues, however, are heavily coded, for few of these pop cultural texts announce themselves as expressly legal. Nonetheless, Lex Populi reads these texts “jurisprudentially,” that is, with an eye to their hidden legal philosophical meanings, enabling connections such as: Tolkien’s Ring as Kelsen’s grundnorm; vampire slaying as legal language’s semiosis; Hogwarts as substantively unjust; and a seriously injured young woman as termination’s rights-bearer. In so doing, Lex Populi attempts not only a jurisprudential reading of popular culture, but a popular rereading of jurisprudence, removing it from the legal experts in order to restore it to the public at large: a lex populi by and for the people.

The concepts of popular consent and limit as applied to the exercise of political authority are fundamental features of parliamentary democracy. Both these concepts played a role in medieval political theorizing, although the meaning and significance of political consent in this thought has not been well understood. In a careful, scholarly, and readable survey of the major political texts from Augustine to Ockham, Arthur Monahan analyses the contribution of medieval thought to the development of these two concepts and to the correlative concept of coercion. This handbook provides a comprehensive introduction to the cutting-edge field of cultural legal studies. What can law’s popular cultures do for law, as a constitutive and interrogative critical practice? This collection explores such a question through the lens of the ‘cultural legal studies’ movement, which proffers a new encounter with the ‘cultural turn’ in law and legal theory. Moving beyond the ‘law ands’ (literature, humanities, culture, film, visual and aesthetics) on which it is based, this book demonstrates how the techniques and practices of cultural legal studies can be used to metamorphose law and the legalities that underpin its popular imaginary. By drawing on three different modes of cultural legal studies – storytelling, technology and jurisprudence – the collection showcases the intersectional practices of cultural legal studies, and law in its popular cultural mode. The contributors to the collection deploy differentiated modes of cultural legal studies practice, adopting diverse philosophical, disciplinary, methodological and theoretical approaches and subjects of examination. The collection draws on this mix of diversity and homogeneity to thread together its overarching theme: that we must take seriously an interrogation of law as culture and in its cultural form. That is, it does not ask how a text ‘represents’ law; but rather how the representational nature of both law and culture intersect so that the ‘juridical’ become visible in various cultural manifestations. In The Business of Alchemy, Pamela Smith explores the relationships among alchemy, the court, and commerce in order to illuminate the cultural history of the Holy Roman Empire in the sixteenth and seventeenth centuries. In showing how an overriding concern with religious salvation was transformed into a concentration on material increase and economic policies, Smith depicts the rise of modern science and early capitalism. In pursuing this narrative, she focuses on that ideal prey of the cultural historian, an intellectual of the second rank whose career and ideas typify those of a generation. Smith follows the career of Johann Joachim Becher (1635-1682) from university to court, his projects from New World colonies to an old-world Pansophic Panopticon, and his ideas from alchemy to economics. Teasing out the many meanings of alchemy for Becher and his contemporaries, she argues that it provided Becher with not only a direct key to power over nature but also a language by which he could convince his princely patrons that their power too must rest on liquid wealth. Agrarian society regarded merchants with suspicion as the nonproductive exploiters of others' labor; however, territorial princes turned to commerce for revenue as the cost of maintaining the state increased. Placing Becher’s career in its social and intellectual context, Smith shows how he attempted to help his patrons assimilate commercial values into noble court culture and to understand the production of surplus capital as natural and legitimate. With emphasis on the practices of natural philosophy and extensive use of archival materials, Smith brings alive the moment of cultural transformation in which science and the modern state emerged.
