Since the third edition of this commentary on the Charter of the United Nations was published in 2012, the text of the Charter has not changed DL but the world has. Central pillars of the international order enshrined in the UN Charter are facing serious challenges, notably the prohibition of the use of force. Human rights, too, have come under increasing pressure, now also from contemporary information technology. Global warming poses fundamental challenges for the world community as a whole in its effort to stabilize global ecosystems. Fully updated, the commentary takes up these and other developments. It features new chapters on Climate Change and the Human Rights Council. The commentary remains the authoritative, article-by-article account of the legislative history, interpretation, and practical application of each and every Charter provision. Written by a team of distinguished scholars and practitioners, this book combines academic research with the insights of practice. It is an indispensable tool of reference for all those interested in the United Nations and its legal significance for the world community. The Commentary will be crucial in combining solid legal foundations with new directions for the development of international law and the United Nations in the twenty-first century

The United Nations Observer Mission in El Salvador (ONUSAL) is the result of dialogue and negotiation between the Salvadorian Government and the Farabundo Marti National Liberation Front (FMLN). It constitutes the first UN attempt to mediate the settlement of an non-international armed conflict. This work studies the benefits and disadvantages intrinsic to a political body in monitoring the respect for international humanitarian law, and analyzes new requirements demanded by the enlargement of the functions of the UN. The analysis is based on the reports of the ONUSAL, prepared during its peace-making phase, and focuses on the question of the extent to which the mission succeeded in assuring a better protection of the norms of humanitarian law. The work is based on a Ph.D. thesis originally written in French. Tathiana Flores Acuña received her doctorate from the European University Institute in Florence in 1994. She now works for the Organization of American States in Costa Rica.

After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.

The UN Military Staff Committee is a misunderstood organ, and never really worked as it was initially envisaged. This book charts its historic development as a means to explain the continuous debate about the reactivation of the Military Staff Committee and, more generally, the unsatisfied need for the Security Council to have a military advisory body so that it does not only depend on the Secretariat to make its decisions on military and security affairs. The author takes a clear stand for the establishment of a military committee with real weight in the decision-making process of the Security Council related to peace operations. The Security Council remains the only international body making decisions in peace and security, authorizing military deployment without advice from a collective body of military experts and advisers. Recreating such a body is the missing part of all UN reform structures undertaken in past years. As the number of UN troops deployed increases, this book will be an important read for all students and scholars of international organisations, security studies and international relations.
