Seven major issues in dispute at the United Nations Conference on the Law of the Sea and affecting the U.S. Navy are examined from the standpoints of Naval interests as well as the Nation and the international community. Solutions to the issues are argued and compared from the perspectives of the international community as a whole, the United States and the U.S. Navy. It is shown that the best solutions for both the United States and its naval force appear to be in the direction of greater international jurisdiction for the world's seas and, thus, the U.S. stands to gain the most from an effective and widely accepted international ocean regime. The chapters, written by a cross-section of practitioners, diplomats, policymakers, and scholars from the three major powers discussed (United States, China, India) explain the opportunities and risks in the Indo-Pacific region and identify specific naval measures needed to enhance maritime security in the region. Maritime Security in the Indo-Pacific opens by introducing the Indo-Pacific and outlining the roles of China, India, and the United States in various maritime issues in the region. There has been a recent increase in clashes between warships asserting rights to navigate and states asserting sovereignty over coastal waters. This book argues for a set of rules which respect the rights of coastal states to protect their sovereignty and of warships to navigate lawfully, whilst also outlining the limits of each. The book addresses the issue of the clash between warships and states by considering the general principles applying to use of force in the law of the sea and the law of national self-defence. It focuses on the right of coastal states to use force to prevent passage of warships which threaten their sovereignty, with particular reference to the specific maritime zones, as well as by warships to ensure passage or to defend themselves.
