Excerpt from The Student's Guide to Executorship Accounts As Honorary Secretary of the Manchester Chartered Accountants' Students' Society for five years, I heard frequent enquiries for a book on Executorship, which, while giving a brief summary of the principal points of the Law, was specially designed to assist a student in neatly setting out answers to such short questions on Accounts as are usually asked at the Examinations of the Institute. It is in the hope that it will answer this purpose that this little Handbook is submitted for the approval of the Students of the Profession. The examples given are such as have been, or may reasonably be expected to be, asked at the Examinations. I shall at all times be pleased to receive suggestions for future usefulness. Excerpt from Executorship Accounts On page 10 against the marginal note "Succession Duty" it is stated that, "as the freehold works are bequeathed without any directions for sale, these pass at once without any act on the part of the Executors." This is not now correct, as since the death of my Testator and the consequent succession of his nephew, the Land Transfer Act of 1897 has been passed, under which the estate in real property vests in the Executor or Administrator, and if it has been specifically devised the assent of the Executor to the devise is necessary to complete it. In the meanwhile the Executor is Trustee for the Devisee. If any rents are received while the property is in the Trustee's possession it will be necessary to open Accounts with the Property, and with tho Devisee, but if the assent is given immediately it will be sufficient to make a note upon the "Principal" Account of the nature of the Property, the name of the Devisee, and the date when assent was given by the Executor. Excerpt from The Law and Practice Relating to the Passing of Executors' Accounts N o apology is necessary for the number of Ameri can eases referred to, more especially in the chapters dealing With testamentary expenses and allowances to and the liabilities of executors and administrators. Much of the law in this respect is grounded on habits and customs of life, and, in many respects, our habits and customs assimilate more closely to those of Ameri cans than to those of Britons. Apart from this the decisions of the American courts, more especially those of the Eastern and south-eastern States, are deservedly held in high repute. I had hoped to be able to incorporate in the Appen dix the new Surrogate Court Rules, but these appear to be no nearer promulgation now than a year ago. Excerpt from Prentice-Hall Tax Service for 1919 This allowance is not based upon the difference between the actual war cost of such facilities and what they would have cost at pre-war prices. Obviously the taxpayer is not entitled to recover or extinguish through amortization more than the difference between the war cost of such property and what he can sell the property for after the war, or if he continues to need and use it in his business, what it would have cost him after the war. As the rule is expressed in Article 183 of the Regulations: The total amount to be extinguished by amortization, in general, is the excess of the unextinguished or unrecovered cost of the property over its maximum value (either for sale or for use as part of the plant or equipment of a going business) under stable post war. Excerpt from Accountants Guide for Executors, Administrators, Assignees, Recievers and Trustees For this reason, it seems to me that an explanation of the manner of keeping the accounts of an estate, under the care of an executor, administrator, trustee, receiver or assignee, would be of service, not only for their own satisfaction and facility in preparing a report, but also for the information of legatees or creditors, who may be interested in an estate and have the right to inquire into the acts of the executor, trustee.
