The ongoing austerity crisis is being felt in all sectors of EU law, but has had a particularly severe impact on labour law. Silvana Sciarra, a leading judge and scholar of EU employment law, considers how solidarity regimes have been shaken by the crisis. She brings together existing European policies in social and employment law, to enhance synergies and developments in a post-crisis discourse. She looks at reactions of national constitutional courts to austerity measures and of international organizations in re-establishing respect of fundamental workers' rights. Criticizing soft law approaches in employment policies, she favours recourse to binding measures connected with selective financial incentives through European funds. She highlights developments in European sector social dialogue and new horizons of transnational collective bargaining in large multinationals. Taking a positive, practical approach, Sciarra shows how social policies can enhance solidarity and social cohesion, through European financial support.

This book investigates the paradox of rich countries of Western Europe, who have high levels of poverty whilst proclaiming its eradication as one of the primary social and economic goals. It looks at how policies often do not achieve their goals, why countries need mechanisms to reduce wage inequality and why they choose to provide universal benefits instead of systems of selective benefits targeted at the poor. Along with cross-countries comparisons, the volume also presents analysis of the minimum income in France, Portugal, Italy, Finland, Ireland, Belgium, and Greece.

This book provides international and transdisciplinary perspectives on Hyperprecarity and Social Structural Transformations in European Societies, USA and Russia enforced through other special transformation processes such as digitalisation, migration and demographic change. It has been observed that precarity and social insecurity do not refer any longer only to certain groups of the society such as unemployed people or to those ones who are ‘traditionally’ more in need of social benefit etc. but it accompanies and affects greater parts of the society, particularly those sections of the middleclass who conceive their social identity merely via their work ethics. Consequentially new forms of social exclusion are being producing taxing the traditional social cohesion in European societies due to the demand of new forms of flexibility and mobility from the working people. This process can be termed with the notion 'Hyperprecarisation'. This book contains contributions from scientists all over Europe, Russia and the USA, who are members of the SUPI network “Social Uncertainty, Prequarity, Inequality”. PD Dr. Rolf Hepp teaches at the Institut for Soziologie at the FU Berlin and coordinates the S.U.P.I.-Network. Dr. David Kergel teaches at Universität Siegen, Medienwissenschaftliches Seminar. Dr. Robert Riesinger, (Prof. a.D., FH Joanneum Graz) is author and researcher for sociology in Steyerberg.

How can the EU's community of welfare states adapt their public policies to economic globalization? What happens when the economic and social aims of the EU come into conflict? This book examines the developing legal regimes and regulation of public services in the UK and other European countries. Public services are examined though a case-study of the complex area of public employment services. These are job-placement and vocational training services which aim to maximize employment and minimize unemployment within EU member States' Active Labour Market policies. Employment services are at the centre of a complex web of rules in both hard and soft forms of law deriving from the EU, national public law and from private, and at times contractual, agreements. They also lie at the crossroads of a series of trends in regulation, and priorities have been inspired by an array of conflicting policy rationales. These policy rationales include the establishment of an open and competitive European internal market, the establishment of an efficient welfare state, the scaling down of state administrative machinery, the fulfilment of core public service responsibilities, and the creation of public-private partnerships. Public employment services provide a highly informative and novel case study of the interaction and conflict between the economic and social aims of the EU and between regulation at national and supranational levels, and the changing forms which this regulation has taken.
