Since 1945, the United Nations has had an internal justice system to handle internal disputes and examine employee conformity with its rules of governance. Based on an exhaustive analysis of 3,067 judgements, advisory opinions, and General Assembly debates on the issue, The Internal Justice of the United Nations offers an unparalleled account of the system’s effectiveness and shortcomings over its seventy year history.

prospects of the High Commissioner proposal with careful scholarship and shrewd judgment. Mr. Clark wrote the first draft of this book under my supervision for the degree of Doctor of the Science of Law at Columbia Law School before returning to take up his career as a law teacher in his native New Zealand. I am delighted that his work, in this improved and updated version, is now being published. It fills a real need, since it is the first book on this important subject. On this occasion it might be appropriate to add a few comments on the history of the High Commissioner proposal. As Mr. Clark indicates, I had something to do with its "revival" in the United States Government during the closing months of the Kennedy Administration. A few details as to how this "revival" took place may perhaps be useful to students of international relations and international organization.

This thoughtful work by the world’s leading authority on the law of United Nations General Assembly Resolutions remains of inestimable value in its assessment of the potential role of these resolutions under the “New World Order.” An insider familiar with the institution’s complexities, Professor Sloan examines with insight and clarity the new opportunities available to the United Nations in a world released from the stifling restraints of the Cold War. The book includes detailed documentary annexes as well as a bibliography and index. Published under the Transnational Publishers imprint.

International lawyers usually disregard the vital functions that general principles of law may play in the decisions of international courts and tribunals. As far as international criminal law is concerned, general principles of law may be crucial to the outcome of an international trial, "inter alia" because the conviction of an accused in respect of a particular charge may depend on the existence of a given defence under this source. This volume examines the role that general principles of law have played in the decisions of international criminal courts and tribunals. In particular, it analyses their alleged a ~subsidiarya (TM) nature, their process of determination, and their transposition from national legal systems into international law. It concludes that general principles of law have played a significant role in the decisions of international criminal courts and tribunals, not only by filling legal gaps, but also by being a fundamental means for the interpretation of legal rules and the enhancement of legal reasoning.

This book examines pathways for how to reinvigorate the United Nations, in light of recent crises. The United Nations requires reinvigoration. The organisation’s supply of global governance falls short of global demand in areas ranging from health to environment, while intra-state armed conflicts are on the rise again, and fullblown inter-state war has returned to the agenda. At the same time, decision-making mechanisms are deadlocked, and their legitimacy is increasingly questioned. But what pathways are there for reinvigorating the United Nations? This book argues for consolidating key principles pertaining to inter-state relations and human rights, for elaborating on the UN system in order to avoid fragmentation and make it possible for it to keep pace with a changing world, and for revisiting UN decision-making structures so that it can become more inclusive and rebuild trust among stakeholders. The volume embraces a comprehensive approach to studying the organisation, and the authors analyse the institutions comprising the UN system, as well as the social context within which actors put these institutions to use. The book contributes to scholarly debates about the United Nations and about how it is embedded in a broader international order currently beset by crises and, ultimately, aims to show what concrete steps for strengthening the organisation might look like. This book will be of much interest to students of international organisations, diplomacy studies, global governance, and International Relations in general.
