This book examines internal political conflicts in the British Empire within the legal framework of treason and sedition. The threat of treason and rebellion pervaded the British Atlantic in the 17th and 18th centuries; Britain's control of its territories was continually threatened by rebellion and war, both at home and in North America. Even after American independence, Britain and its former colony continued to be fearful that opposition and revolution might follow the French example, and both took legal measures to control both speech and political action. This study places these conflicts within a political and legal framework of the laws of treason and sedition as they developed in the British Atlantic. The treason laws originated in the reign of Edward III, and were adapted and modified in the 16th and 17th centuries. They were exported to the colonies, where they underwent both adaptation and elaboration in application in the slave societies as well as those dominated by free settlers. Relationships with natives and European rivals in the Americas affected the definitions of treason in practice, and the divided loyalties of the American revolutionary war added further problems of defining loyalty and treachery. The growth in England and Britain’s merchant marine from the medieval period onwards meant that an increasing number of criminal offences were committed on or against the country’s vessels while they were at sea. Between 1536 and 1834, such crimes were determined at the Admiralty Sessions if brought to trial. This was a special part of the wider Admiralty Court, which, unlike the other forums in that tribunal, used English common law procedure rather than Roman civil law to try its cases. To a modest extent, this produced a ‘hybrid’ court, dominated by the common law but influenced by aspects of Europe’s other major legal tradition. The Admiralty Sessions also had their own (highly singular) regime for executing convicts, used the Marshalsea prison to hold their suspects and displayed the Admiralty Court’s ceremonial silver oar at their hearings and hangings. During the near three centuries of its existence, the Admiralty Sessions faced enormous legal and logistical problems. The crimes they tried might occur thousands of miles and months of sailing time away from England. Assembling evidence that would ‘stand up’ in front of a jury was a constant challenge, not least because of the peripatetic lives of the seafarers who provided most of their witnesses. The forum’s relationship with terrestrial criminal courts in England was often difficult and the demarcation between their respective jurisdictions was complicated and subject to change. Despite all of these problems, the court experienced significant successes, as well as notable failures, in its battle to deal with a litany of serious maritime crimes, ranging from piracy to murder at sea. It also spawned a series of Vice-Admiralty Courts in English and British colonies around the world. This book documents the origins, development and abolition of the Admiralty Sessions. It discusses all of the major crimes that were determined by the forum, and examines some of the more arcane and unusual offences that ended up there. British Captives from the Mediterranean to the Atlantic, 1563-1760 provides the first study of British captives in the North African Atlantic and Mediterranean, from the reign of Elizabeth I to George II. British Slaves and Barbary Corsairs is the first comprehensive study of the thousands of Britons captured and enslaved in North Africa in the early modern period, an issue of intense contemporary concern but almost wholly overlooked in modern histories of Britain. The study charts the course of victims' lives from capture to eventual liberation, death in Barbary, or, for a lucky few, escape. After sketching the outlines of Barbary's government and society, and the world of the corsairs, it describes the trauma of the slave-market, the lives of galley-slaves and labourers, and the fate of female captives. Most captives clung on to their Christian faith, but a significant minority apostatized and accepted Islam. For them, and for Britons who joined the corsairs voluntarily, identity became fluid and multi-layered. Bernard Capp also explores in depth how ransoms were raised by private and public initiatives, and how redemptions were organised by merchants, consuls, and other intermediaries. With most families too poor to raise any ransom, the state came under intense pressure to intervene. From the mid-seventeenth century, the navy played a significant role in 'gunboat diplomacy' that eventually helped end the corsair threat. The Barbary corsairs posed a challenge to most European powers, and the study places the British story within the wider context of Mediterranean slavery, which saw Moors and Christians as both captors and captives.
