La reciente expedición de la Ley 1341 de 2009 implica una transformación radical en el sector de las telecomunicaciones al incorporar un nuevo régimen de las tecnologías de la información y las comunicaciones (TIC). Después de casi veinte años del estatuto anterior consagrado en el Decreto Ley I900 de I990, el legislador adapta el marco legal a las tendencias del derecho comparado surgidas del desarrollo tecnológico del sector y que obligan a reconocer la realidad de la convergencia en los servicios y redes de telecomunicaciones y la convergencia en los sectores informáticos y de telecomunicaciones. Puede afirmarse que existe una modificación de fondo aunque no suficiente, y que apunta a un plan ambicioso, por lo menos en el marco normativo, de lograr la tan ansiada finalidad social del Estado en derecho de acceso de todos los habitantes del territorio nacional al uso de estas nuevas tecnologías.
