The IOPA-IUU is a voluntary instrument that applies to all States and entities and to all fishers. Following the IPOA's introduction, the nature and scope of IUU fishing is addressed. This is followed by the IPOA's objective and principles and the implementation of measures to prevent, deter and eliminate IUU fishing. These measures focus on all State responsibilities, flag State responsibilities, coastal State measures, port State measures, internationally agreed market-related measures, research and regional fisheries management organizations. While the South China Sea dispute remains Vietnam’s top security concern, the country also confronts a variety of growing non-traditional threats, such as illegal fishing, maritime violence, smuggling, ecological degradation and climate change. These issues adversely affect Vietnam’s external relations, socio-economic development, marine ecosystems and political stability, while engendering and exacerbating regional tensions. In response, at the national level, Vietnam has focused on building a blue economy and strengthening its law enforcement capacity. At the international level, Vietnam has participated in a variety of bilateral and multilateral cooperative mechanisms. However, these efforts have been impeded by internal and external factors, such as corruption, inadequate capacity and lack of budget, as well as ASEAN’s institutional limitations and sovereignty sensitivities. To better confront these multifaceted maritime issues, Vietnam will need to (1) formulate a comprehensive national strategy for maritime security; (2) streamline the overlapping responsibilities of maritime security agencies; (3) enhance its maritime domain awareness; (4) ensure proper policy and investment to improve climate resilience and coastal development; and (5) optimize its approach to multilateralism.

Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. This report updates previous studies that measured in economic terms the extent of biological losses attributable to overfishing globally. The new estimates assess these 'sunken billions' at $83 billion annually. The report further shows that a clear path can lead to the recovery of these considerable losses, including through significant reduction in global fishing overcapacity. A breakdown between regions is also included, showing that the effort needed to achieve this reform will not be felt equally throughout the world. While the cost of such reform will likely be high, the expected benefits include an increase in biomass by a factor of 2.7, increase in annual harvests by 13 percent, and a 30-fold increase in annual net benefits accrued to the fisheries sector (from $3 billion to $86 billion annually). This urgent call for action is reinforced by the impacts of climate change on fish stocks and fisheries worldwide.
