FAO has been promoting the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests (VGGT) in several countries and the Federal Republic of Germany had significantly contributed by financially supporting FAO’s activities. The programme contributed through multi-stakeholder platforms to an inclusive dialogue which led in most countries to the emergence of a common vision on land governance and positively influenced the land reform processes. It also triggered changes in mind-set which are needed for long-term improvements at country level. Results have shown that the VGGT, while being international principles of land policy, can be translated into concrete actions at the local level. The evaluation stressed the need for greater attention on developing activities to be carried out in local communities which result in defined, precise and achievable gains on governance of tenure and to continue working on women and youth land access issues.

Small-scale fishers and their communities highly depend on secure access to fisheries resources and to the beaches that allow fishers to access the fishing grounds, to land their catches, and store and maintain their boats, gear and equipment. Landing sites are also often a place that women use for fish processing and marketing activities. These tenure rights for fishing grounds and landing sites are of crucial importance for the livelihoods of small-scale fishers and for food and nutrition security for fishing communities, and for the coastal population in most countries. Most of the landing sites for small-scale fisheries in Ghana are under increasing demand to use the beaches for other purposes, such as tourism, urban and commercial activities. Small-scale fishers also have major challenges pertaining to their exclusive use of the Inshore Exclusive Zone (IEZ), reserved for the small-scale fishing for small pelagic fish. In recent years there are major conflicts with industrial fleet that are trans-shipping (by)-catches of small pelagic fish to canoes at sea, which are subsequently landed unrecorded in Ghana. In addition, the industrial trawlers are regularly fishing illegally within the IEZ for small pelagic fish. Through the European Union Land Governance Programme support has been provided to develop the capacities of small-scale coastal fishing communities to secure their tenure rights, secure the fish landing and processing sites and reduce the incidence of illegal, unreported and unregulated (IUU) fishing. Capacities of clam fishery producers was also developed. The aim was to secure and sustain the livelihoods of the small-scale fishers.

Following the endorsement of the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) by the FAO Committee on Fisheries (COFI) in June 2014, and in line with Paragraph 13.6 of the SSF Guidelines promoting the development of regional plans of action for their implementation, a regional consultation was held to discuss the implementation of the SSF Guidelines in West and Central Africa. The objective of the consultation was to raise awareness of the important role of the small-scale fisheries sector and how this is addressed in the African Union’s Policy Framework and Reform Strategy for Fisheries and Aquaculture in Africa (PFRS), the ECOWAS regional fisheries and aquaculture policy (under development with support from the FIRST programme), and the SSF Guidelines. It also provided an opportunity to share experiences and identify actions needed to support and promote small-scale fisheries in the CECAF region.

This legal paper first considers the obligations of states in relation to gender equality and the adoption of temporary special measures, and the work of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) Committee in clarifying and expanding the concept of temporary special measures. In particular, it shows how the General Recommendations of the Committee have established a clear link between temporary special measures and the achievement of gender equality in the ownership and control of natural resources. It explores a range of national approaches to the use of temporary special measures in legislation, from constitutional recognition, the adoption of framework laws on gender equality and non-discrimination, to their integration into sectoral legislation applicable to land, forests and fisheries. The section highlights some of the measures that countries have adopted to show how their inclusion into sectoral legislation can effectively target de facto inequalities in tenure rights over some key economic resources. It discusses state compliance with CEDAW’s Articles 3 and 4 and shows that generally, countries should make more systematic use of this tool to bridge the gender gap in land, forest and fisheries tenure. Finally, it considers the role of development partners in supporting the adoption of temporary special measures, including through data collection.

The Voluntary Guidelines for Securing Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) are the first international instrument dedicated entirely to the small-scale fisheries sector. In 2007/8 world food prices spiked and global economic crisis set in, leaving hundreds of millions of people unable to access adequate food. The international reaction was swift. In a bid for leadership, the 123 member countries of the United Nations’ Committee on World Food Security (CFS) adopted a series of reforms with the aim of becoming the foremost international, inclusive and intergovernmental platform for food security. Central to the reform was the inclusion of participants (including civil society and the private sector) across all activities of the Committee. Drawing on data collected from policy documents, interviews and participant observation, this book examines the re-organization and functioning of a UN Committee that is coming to be known as a best practice in global governance. Framed by key challenges that plague global governance, the impact and implication of increased civil society engagement are examined by tracing policy negotiations within the CFS, in particular, policy roundtables on smallholder sensitive investment and food price volatility and negotiations on the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security, and the Global Strategic Framework for Food Security and Nutrition. The author shows that through their participation in the Committee, civil society actors are influencing policy outcomes. Yet analysis also reveals that the CFS is being undermined by other actors seeking to gain and maintain influence at the global level. The Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) represent the first ever international instrument dedicated to small-scale fisheries. Since the year 2000, millions of hectares of land in the Global South have been acquired by foreign investors for large-scale agricultural projects, displacing and disrupting rural communities.
