Lying in southwestern Montana are the towns of Virginia City and Nevada City. In 1864 the towns possessed the lure of instant wealth, excitement, and adventure that came from gold mines. Along with this excitement came danger-danger posed by men of unsavory character who would not stop at anything to get what they desired. Five men who were residents of the towns fought back by forming a Vigilance Committee with the goal of bringing justice to the men who terrorized the towns. There have been many theories throughout the years of how the vigilantes financed their quest to bring law and order to the territory of Montana. This book explores the work of John Lott as territorial treasurer, author of the Vigilante Oath, and bookkeeper of the Ferreting Fund, a register of names and amounts of money donated to the Vigilantes to restore law and order. This paper is written not as an attempt to legitimize the actions of the vigilantes, but rather to explore the funding of the organization provided by citizens of Alder Gulch; ordinary people who refused to live in an environment where terror reigned, and they feared for their lives and livelihoods.

A history and legal analysis of vigilantism in Montana in the 1860s, from a state Supreme Court justice and legal historian. Historians and novelists alike have described the vigilantism that took root in the gold-mining communities of Montana in the mid-1860s, but Mark C. Dillon is the first to examine the subject through the prism of American legal history, considering the state of criminal justice and law enforcement in the western territories and also trial procedures, gubernatorial politics, legislative enactments, and constitutional rights. This is the story of Montana Territory in the last half of the nineteenth century, when a massive influx of gold seekers brought murderers and robbers into the region and forced the creation of an organization of law-abiding citizens known as the Vigilantes. Led by Captain James Williams, the Vigilantes sought to stop the blatant activities of more than fifty road agents in the Bannack-Virginia City mining area, who were secretly directed and protected by a local sheriff, Henry Plummer. The first instance of taking the law into their own hands occurred when an impromptu group of men captured, tried, and hanged one notorious killer, George Ives.
