Governments are rightly discussing reform of investment treaties, and of the incredibly powerful system of 'investor-state dispute settlement' (ISDS) upon which they rest. At their core, ISDS treaties are flawed because they very firmly institute wealth-based inequality under international law. In this book, Van Harten explores these claims in the light of the history of early ISDS treaties showing their ties to decolonization and, at times, extreme violence and authoritarianism. Focusing on early ISDS lawsuits and rulings, it is revealed how a small group of lawyers and arbitrators worked to create the legal foundations for massive growth of ISDS since 2000. ISDS-based protections are examined in detail to demonstrate how they give exceptional advantages to the wealthy. Various examples are also offered of how the protections have been used to reconfigure state decision-making and shift sovereign minds in favour of foreign investors. In The Politics of Coercion, Neil Loughlin explains the persistence of Cambodia's authoritarian regime for more than four decades. It provides a historically grounded investigation of the country's ruling coalition: political elites, many drawn from within the state's coercive apparatus, who, in coordination with state-dependent tycoons, have come to control Cambodia's politics and its economy. Loughlin presents new empirical data foregrounding the coercive underpinnings of the modern Cambodian state and its party, the Cambodian People's Party (CPP). The focus on coercion reflects the regime's conflict and postconflict evolution and extractive political economy as the ruling coalition failed to channel popular interests through its political institutions, thus resorting either to low-intensity forms of coercion such as intimidation and surveillance or to high-intensity coercion such as violent crackdowns and extrajudicial killings. Through a critical reevaluation of the regime's origins and evolution in its relationship with citizens, The Politics of Coercion reconceptualizes the CPP to emphasize the obstacles—structural, institutional, and distributional—to building a mass-based clientelist or developmentally legitimate authoritarian party.

Welfare states are the product of economic, political and social interactions, and undergo changes as these interactions transform. Existing welfare state theories mainly tend to explain the emergence and development of the welfare state in the western, industrialized and capitalist world. While the states of Central and Eastern Europe have recently been integrated in the academic discourse, the countries of the former Yugoslavia have been predominantly excluded from comparative analysis. Issues of nationalism and ethnic polarization have been prevalent there while socio-economic issues have been put on the back burner. This book explores what happened to the strong social states and relatively equal societies which existed in Slovenia, Croatia, Serbia and Macedonia, and looks into what accounts for these diverse outcomes. By investigating the applicability of the theories on welfare state development and typologization, it fills in the gap in the welfare state literature. It offers an original typology of social citizenship that takes into account the diversity of welfare policy formations across the region. The aim of this typology is not to compete with existing ones, but rather to offer a framework for better understanding of states that do not necessarily fit into known explanatory categories. In a global context of changing economic circumstances and contending political responses, macroeconomic policy and welfare state reform become order of the day. By featuring the ways that states adjust to new pressures, this book’s arguments may come in handy to those trying to make sense of the crisis and the powers that drive the policy solutions.
