This book explores innovative and context-driven political and legal policy measures designed to expand the powers of the African Union (AU) in order to meaningfully drive the continental integration process. In this regard, the book addresses issues of context, political will, and innovative and inclusive approaches as essential elements that must be considered. Africa is currently experiencing one of the most critical phases of its integrative development. Since 2015, there have been increasing efforts to develop policies and practices that grant the AU broader powers to coordinate and create binding rules regarding the regional integration process. In other words, these processes seek to endow the AU with supranational powers like those exercised by the European Union, which, despite its internal problems, remains the most successful experiment in supranationalism in the world. This has included the decision to finance the AU through a 0.2% tax on eligible imports into member states; the decision to reduce the number of AU Commission portfolios from eight to six; the adoption and entry into force of the much touted Agreement establishing the African Continental Free Trade Area; the adoption of the Protocol to the Treaty Establishing the African Economic Community Relating to Free Movement of Persons, Right to Residence and Right of Establishment; and the adoption of the AU Agenda 2063 policy framework in 2015. How these processes will change the direction of regional integration in Africa, the book argues, largely depends on the existence of quality-driven institutions.

This book examines how internal and external security are blurring at the EU level, and the implications this has for EU security governance and the EU as a security actor. The EU claims that ‘internal and external security are inseparable’ and requires a more integrated approach. This book critically assesses this claim in relation to the threats facing the EU, its responses to them, and the practical and normative implications for EU security governance and actorness. It sets out a novel conceptual framework – the EU security continuum - to examine the ways and extent to which internal and external security are blurring along three axes: geographic, bureaucratic, and functional. This is done through an analysis of four key security issues, regional conflict, terrorism, organised crime, and cybersecurity. The book demonstrates that, to varying degrees, these security threats and/or responses do transcend boundaries. However, institutional turf wars and capability silos hamper the EU’s integrated approach and, therefore, its management of transboundary security threats. Yet, the EU’s pursuit of an integrated approach is reframing its claimed normative distinctiveness toward a more practical one, based on a transnational and multidimensional approach. Such a rearticulation, if implemented, would make the EU a genuinely transboundary security actor, properly structured and equipped to tackle the 21st century’s internal-external security continuum. The equality jurisprudence of the Court of Justice of the European Union has long drawn criticism for its almost total reliance on Aristotle’s doctrine that likes should be treated like, and unlikes unlike. As has often been shown, this is a blunt tool, entrenching assumptions and promoting difference-blindness: the symptoms of simplicity. In this book, Richard Lang proposes that the EU’s judges complement the Aristotelian test with a new one based on Michael Walzer’s theory of Complex Equality, and illustrates how analysing allegedly discriminatory acts, not in terms of comparisons of the actors involved, but rather in terms of distributions and meanings of goods, would enable them to reach decisions with new dexterity and to resolve conflicts without sacrificing diversity.
