Excerpt from The Wheeling and Lake Erie Railroad Company: Plan and Agreement of Reorganization, Dated September 20, 1916 The decree of foreclosure and sale of the properties of The Wheeling and Lake Erie Railroad Company (hereinafter called the Old Company) entered April 1, 1914, was affirmed May 12, 1916, by the Circuit Court of Appeals for the Sixth Circuit. By the decree it was adjudged that the three-year Five Per Cent. Gold Notes (hereinafter called three-year Notes) due August 1, 1908, of the Old Company were valid, that the pledge of of General Mortgage Bonds of the Old Company to secure the notes was valid to the extent of the amount due upon the notes for principal and interest and that the General Mortgage constituted a valid lien upon the property of the Old Company. The amount due upon the notes on the date of the decree was and the interest at 570 to November 1, 1916, amounts to the further sum of making the total amount due on November 1, 1916, Notice of the sale of the properties on October 30, 1916, is now being published.
