Excerpt from The Political and Economic Doctrines By common consent the most notable and one of the most statesmanlike figures in our whole judicial history is that of John Marshall. No other name is comparable with his in fame or honor in this singular field of statesmanlike judicial control, - a field of our own marking out and creation, a statesmanship peculiar to our own annals. Marshall may be said to have created for us the principles of interpretation that have governed our national development. He created them like a great lawyer, master of the fundamental conceptions that have enlightened all great lawyers in the administration of law and have made it seem in their hands a system of life, not a mere body of technical rules; he created them also like a great statesman who sees his way as clearly without precedent as with it to those renderings of charter and statute that will vivify their spirit and enlarge their letter without straining a single tissue of the vital stuff of which they are made. A thoughtful English judge has distinguished between those extensions of the meaning of law by interpretation that are the product of insight and conceived in the spirit of the law itself and those that are the product of sheer will, of the mere determination that the law shall mean what it is convenient to have it mean. Marshall's interpretations were the products of insight. His learning was the learning of the seer, saturated with the spirit of the law, instinct with its principle of growth. No other method, no other principle, has legitimate place in a system that depends for its very life upon its integrity, upon the candor and good conscience of its processes, upon keeping faith with its standards and its immemorial promises. Our courts have stood the test, chiefly because John Marshall presided over their processes during the formative period of our national life. He was of the school and temper of Washington. He read constitutions in search of their spirit and purpose and understood them in the light of the conceptions under the influence of which they were framed. Excerpt from Principles of Political Economy Perhaps I may also be allowed to remark, that the excess of impartiality for which I am taken to task has not been the char acteristic feature of treatises on political economy which have been hitherto published in France. For several generations these books had been in the habit of presenting political economy in only one light, - the point of view of the Liberal school. There is, then, no reason to murmur if later treatises should break with a tradi tion which was beginning to assume the shape of a law, should restore their rightful place to doctrines which have heretofore been proscribed, and should give their due share of justice even to notions which do not command our assent; for thus can be applied Shakespeare's admirable maxim. Excerpt from Principles of Political Economy: Applied to the Condition, the Resources, and the Institutions of the American People The work was not designed to be wholly controversial and original; besides suggesting the doctrines which are to take the place of those which have been rejected, it was intended to contain a summary of what is most valuable in other treatises upon the subject, so as to form a con venient text-book of instruction in American colleges. Most teachers will probably accept the conclusion which I have formed, after many years' experience, that it is a wearisome and hopeless task to at tempt to instruct a class Of pupils from any Of the English or French treatises upon the science. This volume contains the substance of a course of lectures upon Political Economy, first delivered before the Lowell Institute in Boston five years ago, and afterwards repeated, with many changes and additions, before successive classes in college. It also comprises all that was deemed worthy of preservation in a series of articles upon various topics in the science, which have been published during the last ten years in the North American Review. I have not deemed it necessary to rewrite what was at first carefully prepared for publication, when time and further reflection had not suggested any change of doctrine, or any material improvements in illustration or phraseology. Excerpt from Some Leading: Principles of Political Economy Newly Expounded Though the following work is an attempt to recast some considerable portion of Political Economy, I should be sorry it were regarded as in any sense antagonistic in its attitude toward the science built up by the labors of Adam Smith, Malthus, Ricardo, and Mill. On the contrary, my hope is that it will - should its reasonings find acceptance - strengthen, in some sensible degree, and add consistence to that fabric. As regards those assumptions respecting human character and the physical conditions of external nature which constitute the ultimate premises of economic science, the position I have taken is identical with that of the four great writers I have named; and I have endeavored also to follow the method of combined deduction and verification by comparison with facts, which was theirs, and which is, as I believe, the only fruitful, or indeed possible method in economic inquiry. Nor do the final conclusions which I have reached differ very widely on any important points from those at which they had arrived. The points on which I have ventured to join issue with them are what, in Bacon's language, may be called the axiomata media of the science - those intermediate principles by means of which the detailed results are connected with the higher causes which produce them. If I have not deceived myself, there is in this portion of Political Economy, as at present generally received, no small proportion of faulty material; and the present work may be regarded as an attempt, so far as it goes, to replace this element of weakness with matter better fitted to endure the strain of modern criticism. Excerpt from The Working Principles of Political Economy in a New and Practical Form: A Book The aim of this book is to give, in small compass, a sufficient view of economic doctrine for the ordinary needs of intelligent citizens. I have had two principal motives in writing it. In the first place, I wished to show that the principles of Political Economy may be developed in such a form as to bring out, more clearly than is done in the standard books, their close and vital connection with every - day industry. In the second place, I wished to suggest some modifications, chiefly in points of detail, of the conclusions commonly accepted hitherto by the leading economists. Excerpt from The New Tendencies of Political Economy The doctrines of the historical school in political economy lead to no partisanship whatever. They are held equally by free traders and by protectionists in Europe. The underlying motive of their system is the right of individual and of national judg ment to determine upon a given state of facts, what policy, in respect of production and exchange, it is wise to pursue bore and now. It treats political economy as a science, not of pure principles, but of applied principles, and this alone makes pos sible a progressive fiscal policy, moulding itself according to the traditions, the usages, the aspirations, and the actual condition of a free people. This is eminently the economic system suited to the wants of the American people. It deals with the past without contumely, and it welcomes the future without prejudice. No man who looks at the history of past American legislation on the subject of the tariff, in a calm and philosophic spirit, can fail to admit that it is full of ignorance, of vacillation and of mistakes. We might have been abreast of England in opening our markets freely to the world, if our tariff policy had been consistent and progressive. If the English House of Commons has legislated for mankind rather than for man, the American Congress has legislated for man rather than for mankind. In other words, the Committee of Ways and Means has always been the center of personal and individual and local interests, instead of consulting and rep resenting the average interests of American citizens - occupying a great continent with different productions and different wants. I do not say that the harmonizing of those interests is not at all times difficult, but it does seem to me that if the fiscal policy of the country were put beyond the pale of party, as completely as has been done in Great Britain since the repeal of the Corn Laws, a system might be eliminated which should respect traditions, conciliate labor and make rapid strides in the direction of commercial freedom. In this as in most public questions the truth lies between the extremes - Media latissimus ibis. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Elements of Political Economy Some months ago, the present publishers of Dr. Wayland's book requested the writer to make a revision Of that work. Fully' believing that the doctrines and the general aim and methods of that eminent instructor on this subject were sound and wise, and that the press ing want of the class-room in our institutions of higher education, was not fully met by any one of the excellent treatises before the public, be consented and assumed the undertaking. It was soon found, however, that a mere revision of the book would not accomplish the desired object. Comparatively few pages of the original work could be used as they stood. In the result, while scarcely any change has been made in the opinions presented, the arrangement and the forms of statement have been quite generally recast with considerable condensation and many needed additions.
