Excerpt from The Law of Electric Wires in Streets and Highways The use of the streets for lines of electric wires has increased very much since the iSrst edition of this book was written. Many of the questions then discussed as new have now been definitely settled by the general agreement of judicial opinion, and different questions have since become the subject of controversy. The rights of the owners of abutting land have been considered in many later cases; but, except with regard to the use of streets for telegraph and telephone wires, there is now little difference of judicial opinion upon this subject. The questions that have become of greater practical importance are those relating to the powers of municipalities over the use of the streets for electric wires; the power of condemnation where private rights are involved; the interference of one kind of line with another; the liability for injuries arising from negligent construction or the use of dangerous currents, and the power of the states to impose license fees and franchise taxes. Although some of the questions discussed at some length in the first edition have been settled by subsequent decisions following the tendency that was then pointed out, it has seemed best to retain what was then written and to add to it a brief account of the later cases so as to present the whole course of judicial decision upon the subject.
