Excerpt from The Federal Constitution of the Swiss Confederation: September 12, 1848; With Art, XLI and XLVIII as Amended January 14, 1866 To a native of Switzerland nothing could be more gratifying than to notice the frequent manifestations of popular sympathy in England and the United States, toward the country where republicanism has maintained a foot-hold for the last five hundred years. Having thus the love of country so innate in a Swiss, almost daily stimulated by the many encomiums bestowed upon the land of his birth, its scenery, institutions, and people, the translator was induced to think a rendering into English of the instrument which so effectually cemented into a general whole the varied interests of twenty-two distinct governments, could not but prove acceptable to its Anglo-Saxon admirers. It was considered irrelevant to give a detailed account of the causes which led to the adoption of the present excellent Constitution, as it would occupy a space wholly disproportionate to the nature of the present publication; suffice it to slay, that prior to 1848, Switzerland was only governed by the very inadequate laws of a Confederacy similar to those of the United Spates previous to the framing of their Constitution, in 1787. Which European and non-European ideas and practices facilitated the shaping of European unity? Or rather, which pursuits led to deadlocks in the cooperation between states? The book seeks answers to these questions by surveying the historical attempts at realizing supranational patterns of governance in Europe since the Middle Ages. The main focus is on the nineteenth and twentieth century organizational models of European unification. The analysis draws on an abundance of historical and legal source material. While the author encourages critical thinking about European integration, the exploration is admittedly based on specific values. Éva Bóka claims that the struggle for the humanization of power with its democratic creative force has been the major driver in the development of the system of liberties and the idea of European unity. Addresses why, when, and how sovereign states give up some of their sovereignity to form a larger union Starting from the premise that the system of independent, sovereign, territorial states, which was the subject of political science and international relations studies in the twentieth century, has entered a transition toward something new, noted political scientist Leslie F. Goldstein examines the development of the European Union by blending comparative and historical institutionalist approaches. She argues that the most useful framework for understanding the kinds of "supra-state" formations that are increasingly apparent in the beginning of the third millennium is comparative analysis of the formative epochs of federations of the past that formed voluntarily from previously independent states. In Constituting Federal Sovereignty: The European Union in Comparative Context Goldstein identifies three significant predecessors to today's European Union: the Dutch Union of the 17th century, the United States of America from the 1787 Constitution to the Civil War, and the first half-century of the modern Swiss federation, beginning in 1848. She examines the processes by which federalization took place, what made for its success, and what contributed to its problems. Brazil has a very peculiar tax collection power distribution and revenue sharing system, that splits three way the consumption tax, giving taxation powers over goods circulation to the States, over services to the Municipalities and over production to the Union. The Brazilian State circulation of goods tax, whose regulations require unanimity to incentives and benefits concessions, even though the 27 Brazilian States development state are disparate, generates a "fiscal war" / State competition that costs 30 billion Brazilian Reais (6 billion Swiss Francs) yearly and the attempts at settling State Competition are clearly failing, while Switzerland, which has a similar political organization, seems to have a reasonable and functional system. This dissertation, requirement for the obtaining the title of Doctor in International Tax law, takes a case study approach to compare these two systems, specifically taxable events, financial transfer mechanisms and their rules to avoid State / Canton tax competition to assess if the Swiss system for tax collection power distribution and revenue sharing is a feasible solution to reduce the adverse effects of State tax competition in Brazil.
