The Ethics of Banking analyzes the systemic and the ethical mistakes that led to the crisis. It keeps the middle ground between excusing all failures by the argument of a systemic crisis not to be taken responsibility for by the financial managers and the moralistic reproach that only moral failure is at the origin of the crisis. It investigates the role of speculation in the formation of the crisis and distinguishes between productive speculation for hedging and for securing market liquidity on the one hand, and unproductive and even detrimental hyper-speculation going far beyond of the degree of speculation that is necessary in a developed economy for the liquidity of financial markets, on the other hand. Hyper-speculation has increased the risks of the financial system and is still doing so.

The solution to the uninhibited lending that was commonplace before the financial crisis has been to introduce tighter regulation to ensure robustness within banks. However, this solution has overlooked the underlying problem of ethical failure in the industry. In the wake of numerous bank collapses, many survivors continue in unprincipled conduct because ethical virtues have not been instilled. This book investigates the ethical basis of banking practice. It explores the conflict between the interests of banks and their customers, and how this conflict plays out in relation to the lending policies and fee structures of banks. Where such lending policies have a significant effect on banks, their customers and a range of stakeholders, the author investigates the views of leading bankers on their lending practices. The author then goes on to debate the events of the global financial crisis from a moral perspective, and argues that ethical failure triggered the American sub-prime calamities which have devastated homeowners and the global economy. The book argues that American banks and regulators both operated on the erroneous supposition that the quest after extreme profits would be restrained by free market forces. Where banks have a central role and importance in all commerce and hence in all societies, the author concludes by revealing a set of virtues that are necessary for banks to espouse moral conduct. He suggests that these virtues can be embedded through leadership and cultural change, with the aim of developing an account of the virtues appropriate to bankers and banking.

Discussing ethics applied to finance can become a trivial and selfjustifying task if left to the practical men, or a task with no connection to reality, if performed by philosophers. This book, however, turns out to be an exciting piece of work, useful, provocative, full of ideas and suggestions, as experts in ethics discuss specific issues related to the financial institutions and markets, with the men and women that carry out the daily practice in such institutions and markets, as well as with scholars of economics and finance. Thus, the book covers everything from daily subjects to issues of a deeper nature, using a simple and clear language with solid foundations in economics and ethics, from a necessarily plural and open perspective.

Banks are frequently considered usurers. Is it possible to talk about ethics when you analyse banking activity? This book focuses on this question and starts with the history and the philosophy. Philosophers like Aristotle, Immanuel Kant and John Stuart Mill proposed different theories about the need for ethics in finance. If we accept Mill's thought, the production of wealth in society is driven by the personal pursuit of profit. But - unfortunately - this does not, on its own, ensure collective well-being. It must be guided by a superior mechanism which transforms it into wealth for all. This introduces the role of financial institutions, which often have to comply with legal obligations. The book focuses on the role that these institutions have in supporting the ‘ethical’ use of money. The author analyses a number of cases in banks and the financial industry and discusses topics like anti-money laundering, anti-usury, islamic finance, microcredit and bank rescue systems, including not only best practices but also examples of unethical financial management.

Research Paper (undergraduate) from the year 2014 in the subject Business economics - Business Management, Corporate Governance, grade: 97.00, La Trobe University Melbourne, language: English, abstract: This report analyses the external and internal business environments that could be the cause of the ethical lapses; giving steps towards mitigating the lapse. Ethical issues and compliance are a challenge facing Bank of America. Ethical issues affect all the stakeholders in a given business. There has been a perception that the financial institutions across the world tend to be more unethical than any other forms of business. This perception could be justified by the issues facing Bank of America. Complaints of constant lapses in the ethical culture of the bank are rife. The most recent ethical scandal was where the bank is accused to be only interested in short-term returns and not paying attention to the products that are suitable for customers. According to Mujtab (2010:23), the implementation of the Payment Protection Insurance by the Bank of America is an unacceptable measure in respect to the Finance Act (2001). This insurance policy saw overdraft charges being imposed on small business account holders. Interest swaps were also charged on small business holders, a thing that is only done on large corporations by other banking institutions. On the 25 June 2012, the Financial Services Authority (FSA) announced that it had found numerous errors in the way Bank of America had sold complex financial products to around 25,000 small and medium sized businesses. These interest swabs were designed to protect small-sized business customers. However, the mis-selling by the bank resulted to severe effects on the small businesses. The ethical concerns raised here were that the policy was too complex for the business owners to appreciate and that the product was conditional upon the clients. The bank has come under immense public condemnation calling for cultural and management change.

Master's Thesis from the year 2013 in the subject Business economics - Banking, Stock Exchanges, Insurance, Accounting, grade: 1,0, University of Westminster (Westminster Business School), course: International Finance, language: English, abstract: Because Ethical Banks have developed from niche players to serious competition for traditional banks, supposedly Ethical Banks and even traditional banks use the term Ethical Bank in order to sell bank services under the cloak of sustainable and ethically correct business conduct. Therefore, the focus of this research is to make truly Ethical Banks distinguishable from traditional banks by investigating, analysing and determining principles, Ethical Banks have to fulfil or refrain from in order to call themselves truly ethical. Based on the results of the academic research, a web- based survey identifies bank customer’s attitude towards sustainability and ethics in general, their banking, as well as their ethical attitude towards nine areas of business, banks may be confronted with. The survey result build the basis for a list of positive and negative Ethical Guiding Principles (EGPs), which should serve as a general standard for Ethical Banks that want to settle down within the European Economic Area and Switzerland. The main conclusion drawn from this study is a comprehensive list of positive and negative EGPs, applicable either directly to Ethical Banks or as a basis for further research. But because of the ever-changing environmental, social and legal environment, EGPs need to be continuously reviewed and validated. If directly implemented, a control mechanism within or outside the bank must monitor and ensure compliance with these principles.
