Excerpt from The Law of Torts HE author's aim has changed somewhat since the first edition of this work was published. The book was originally written for the beginner; it is now intended as well for the advanced student, whether in the Law School or at the Bar. Hence (1) the substitution of the more complete statement of General Doctrine at the beginning for the slight Introduction of the first edition, (2) an extension of the text generally, and (3) a larger working equipment of notes. Some rearrangement too of chapters, or parts of chapters, has been found necessary either by recent decisions or by further experience in teaching. This is particularly true of the chapters dealing with interferences with Contract, and the long chapter on Negligence. It is proper to repeat what was said in the Preface to the first edition, that The end in View is sought by presenting and considering three or four fundamental duties, in which are found the elements of the law of Torts. These are (1) the duty to refrain from fraud and malice, (2) certain absolute duties - duties, that is to say, independent of any real or nominal attitude of mind, and (3) the duty to refrain from negligence.' Excerpt from Essentials to the Law of Damages Today, as is well known, the situation is altogether dif ferent. In contract, and as to pecuniary elements of dam age in-tort, the court can, and does, exercise rather a close control over the amount of damages; but, as to non-pecuniary elements of damage in torts, the jury may exercise a discretion of considerable breadth, for it is, as to such elements, exceedingly difficult, in most cases, to say that a verdict is excessive or inadequate, and it is altogether impossible to lay down practically complete general rules as in contract. Excerpt from Elements of the Law of Torts for the Use of Students The classification of Mr. Harriman shows the spirit and the hand of the reformer; it Shows a de sire to turn the law, wherever practicable, from haphazard and devious lines into a straight-forward course. In other words, it has logic in view as an object to be approached as nearly as possible. Not withstanding the dangers of it, I am not willing to allow it to appear that I am not in sympathy with such an aim, however closely my own work may follow the beaten pathways. It has been my aim to furnish the practitioner with a useful and convenient treatise, embracing the latest statement Of the law and the most recent authorities; and I entertain a hope that its general usefulness may be largely augmented by the system and method I have pursued.
