On April 13, 2009, the Ohio Department of Transportation ("ODOT") received an anonymous complaint alleging ODOT Management Analyst Supervisor 2 Darreyl D. Davis conducted personal and political business on state time. ODOT forwarded the complaint to the Office of the Inspector General. Our investigation confirmed that over several years Davis spent hundreds of hours at work exchanging e-mails and phone calls that were personal or political in nature. Even allowing for personal time, such as lunch and breaks, Davis collected at least $14,990 in state pay for 379 hours of work time he spent on personal phone calls, dating back to April 2007. The person with whom he most frequently spoke and corresponded during work hours was Sheila Edwards, an Executive Secretary 1 with the Ohio Department of Health. Particularly troubling, Davis used his ODOT e-mail account, and his position as Mayor of Trotwood, to help Edwards secure a $5,000 share of a $50,000 contract he orchestrated between the City of Trotwood and a development consultant. Our investigation substantiated the allegation that Davis misused state time for personal and political purposes, misconduct that was exacerbated because Davis engaged another state employee in the activities.

Per the Ohio Revised Code, the Ohio Department of Transportation (ODOT) adopted policies, procedures, and manuals to provide guidelines and requirements to the department's personnel who have purchasing authority. This investigation reviewed transactions and actions taken by ODOT employees and vendors to determine whether the transactions were in compliance with ODOT policies and procedures. The vendors and affiliated companies reviewed included the following: Ace Truck Equipment, A & A Safety, Southeastern Equipment, Rath Builders Supply, and Pengwyn. As part of this investigation, transactions involving Bain Industries, Bain Enterprises, Horner Construction, and Ebony Construction were also reviewed.

On November 16, 2017, an Ohio Department of Transportation (ODOT) administrative staff member learned that Transportation Manager 3 Shannon Hitt used her ODOT-issued computer equipment to assist her husband in his for-profit business. The administrative staff member reported this information to District 2 Director Patrick McColley who then referred the matter to the ODOT Office of Investigative Services (ODOT-OIS). ODOT-OIS began an internal investigation and found that Matthew Hitt, the husband of Shannon Hitt, was the owner of "Classic Industries," located in Swanton, Ohio. During the ODOT-OIS investigation, items were discovered on Shannon Hitt's shared ODOT network drive that utilized the Classic Industries logo and letterhead. ODOT-OIS referred this matter to the Office of the Ohio Inspector General, and an investigation was opened on December 1, 2017.

INITIAL ALLEGATION AND COMPLAINT SUMMARY: On November 9, 2018, the Office of the Ohio Inspector General received an anonymous complaint alleging inappropriate conduct by Ohio Department of Transportation (ODOT) District 11 Sourcing Supervisor Scott Bates and his supervisor, Labor Relations Office 3 Chad Cline. The complaint alleged that Bates and Cline inappropriately approved the purchase of pipe products from ODOT vendor Beagle Hill Services, LLC (BHS). BHS was owned by Brenda Butler, who is the mother of Bates. Cline allegedly was aware of this conflict and still allowed Bates to have a role in managing ODOT's purchased and invoices from Beagle Hill Services. Additionally, the complaint alleged that Bates acted inappropriately by seeking secondary employment at BHS. Based upon the allegations contained in the complaint, the Office of the Ohio Inspector General opened an investigation into these matters. During the course of investigation into the initial allegations of inappropriate conduct by Bates and Cline as it related to BHS and the secondary employment of Bates, allegations also surfaced that there was suspected retaliation against several of the ODOT employees interviewed as a part of the investigation.
