Since the inception and design of Canada's Employment Insurance (EI) program, the Canadian economy and labour market have undergone dramatic changes. It is clear that EI has not kept pace with those changes, and experts and advocates agree that the program is no longer effective or equitable. Making EI Work is the result of a panel of distinguished scholars gathered by the Mowat Centre Employment Insurance Task Force to analyze the strengths, weaknesses, and future directions of EI. This book examines how and to what extent the European Employment Strategy and the Open Method of Coordination (OMC) on Social Protection and Social Inclusion have influenced national labour market and social welfare policies. Focusing on the implementation of the OMC in different national environments, this book examines how the proposals and targets of the OMC are interpreted and implemented within the context of existing national employment and welfare regimes. At a theoretical level and on the basis of national case studies, the book considers how OMC objectives, guidelines, targets, and recommendations may reshape the domestic institutional framework, how learning and participation of governmental bodies are organized across different hierarchical levels, and how non-state actors may be involved in the formulation and implementation of national reform plans. This book begins from the central premise that progressive social change requires collective struggle underpinned by a clear strategy, and that processes of neoliberal globalisation have altered the cartography upon which social struggle takes place. Drawing on insights from the knowledge production processes of labour movements around the world, this research seeks to highlight the central importance of knowledge production and processes of learning within social movements. Providing both a comprehensive theoretical and empirical introduction to the relationship between globalisation, knowledge and social movement strategy, the authors contend that the production and dissemination of alternative knowledge is central to a resurgence of working-class power. The development of non-binding new governance methods has challenged the traditional ideals of EU law by suggesting that soft norms and executive networks may provide a viable alternative. Rather than see law and new governance as oppositional projects, Mark Dawson argues that new governance can be seen as an example of legal 'transformation', in which soft norms and hard law institutions begin to cohabit and interact. He charts this transformation by analysing the Open Method of Coordination (OMC) for Social Inclusion and Protection. While this process illustrates some of the concrete advantages for EU social policy which new governance has brought, it also illustrates their extensive legitimacy challenges. Methods like the OMC have both excluded traditional institutions, such as Courts and Parliaments, and altered the boundaries of domestic constitutional frameworks. The book concludes with some practical suggestions for how a political 'constitutionalisation' of new governance could look.
