ITAR, which controls defense trade, includes the U.S. Munitions List (USML) which specifies categories of defense articles and services covered by the regulations. In 1999, space satellites were added to the USML. In 2002 ITAR was amended to exclude U.S. universities from having to obtain ITAR licenses when performing fundamental research involving foreign countries and/or persons. Despite this provision, there remains considerable uncertainty among university researchers about whether the regulations apply to their research leading to a rather conservative interpretation of the regulations and the imposition of burdens that might not be necessary. To explore this concern, NASA asked the NRC to organize a workshop of all stakeholders on the implications of ITAR for space science. This book presents a summary of the workshop discussions including those on perspectives on recent developments and implementation of ITAR; overarching issues; problems arising from ITAR's implementation; and opportunities for near-term actions and improvements.

Export controls definitively impact international cooperation in outer space. Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.

The International Traffic in Arms Regulations (ITAR) is putting United States (U.S.) advanced technology and weapons companies at a competitive disadvantage, particularly in the fields of satellite manufacturing and technology. Unnecessary and inefficient bureaucratic review, coupled with the overly stringent application of needlessly restrictive regulations, causes U.S. companies to lose foreign contracts that were once assured. The negative economic impact of the ITAR has permitted foreign companies and governments to enter markets that were previously not competitively open to them. As the U.S. commercial satellite market share continues to erode, the U.S. risks losing technical dominance, thereby negatively impacting national security. This paper examines the theory and history behind export controls and the current United States export control system, the regulations implemented to enforce the export control system and the negative national security implications of the ITAR. Seven recommendations to "fix the ITAR" are proposed in an effort to preserve U.S. space industry superiority as is consistent with the dictates of the U.S. National Security Strategy.

The legal regime of outer space, as enshrined in the Declaration of Legal Principles Governing the Activities of States in the Exploration and Use of Outer Space (General Assembly Resolution 1962 (XVIII), adopted in 1963, and in the 1967 Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies, while prohibiting the appropriation of space by any means, envisages exploration for the bene?t and in the interest of all countries on a basis of equality and in accordance with international law. Freedom of scienti?c investigation is also contemplated. Elaborating on these instruments, the Assembly in 1996 adopted the Declaration on International Cooperation in the Exploration and Use of Outer Space (RES 51/122), in which it called for heightened international co-operation, with part- ular attention to be given to the bene?t for and the interests of developing countries and countries with nascent space programmes. Thus, it is self-evident that the outer space regime, including the 1972 Liability Convention, envisages the conduct of national activities “for the bene?t and in the interests of all countries, irrespective of their degree of economic or scienti?c dev- opment”. In this regard, Article 6 of the 1967 Treaty not only provides for national activities in outer space, but for international responsibility whether such activities are carried out by governmental agencies or non-governmental entities, and aims at ensuring that national activities are conducted in conformity with the Treaty.

In response to requests from Congress, NASA asked the National Research Council to undertake a decadal survey of life and physical sciences in microgravity. Developed in consultation with members of the life and physical sciences communities, the guiding principle for the study is to set an agenda for research for the next decade that will allow the use of the space environment to solve complex problems in life and physical sciences so as to deliver both new knowledge and practical benefits for humankind as we become a spacefaring people. Through an examination of case studies, agency briefings, and existing reports, and drawing on personal knowledge and direct experience, the Committee on Assessment of Impediments to Interagency Cooperation on Space and Earth Science Missions found that candidate projects for multiagency collaboration in the development and implementation of Earth-observing or space science missions are often intrinsically complex and, therefore costly, and that a multiagency approach to developing these missions typically results in additional complexity and cost. Advocates of collaboration have sometimes underestimated the difficulties and associated costs and risks of dividing responsibility and accountability between two or more partners; they also discount the possibility that collaboration will increase the risk in meeting performance objectives. This committee's principal recommendation is that agencies should conduct Earth and space science projects independently unless: It is judged that cooperation will result in significant added scientific value to the project over what could be achieved by a single agency alone; or Unique capabilities reside within one agency that are necessary for the mission success of a project managed by another agency; or The project is intended to transfer from research to operations necessitating a change in responsibility from one agency to another during the project; or There are other compelling reasons to pursue collaboration, for example, a desire to build capacity at one of the cooperating agencies. Even when the total project cost may increase, parties may still find collaboration attractive if their share of a mission is more affordable than funding it alone. In these cases, alternatives to interdependent reliance on another government agency should be considered. For example, agencies may find that buying services from another agency or pursuing interagency coordination of spaceflight data collection is preferable to fully interdependent cooperation.
