Excerpt from Reports of Cases Argued and Determined in the Supreme Court of Idaho Territory, Vol. 1: From January Term, 1866, to September Term, 1880, Inclusive The territory of Idaho was organized by the act of con gress, approved March 3, 1863. The ninth section of that act vests the judicial power of the territory in a supreme court, district courts, probate courts, and justices of the peace. The supreme court consists of a chief justice and two associate justices, who are required to hold a term at the seat of government of the territory, annually. The terri tory is divided into three judicial districts, and a district court is held in the several organized counties of each dis triet, by one of the justices of the supreme court. The first term of the supreme court of Idaho was held in Boise city, the seat of government of the territory, com mancing in January, 1866. In the year 1867, a small vol ume of the decisions rendered was published, and called Vol ume 1 of Idaho Reports; but as these decisions are now out of print, the act of the legislature, approved December 28, 1880, authorizing the publication of this volume, pro vides that it shall contain all the decisions of the court from its organization to the present time; and, to distinguish it from the volume above referred to, the act provides that this shall be known as Volume 1, New Series.
