L’État a toujours intérêt à une sanction rapide et certaine des infractions pénales et il peut être tenté de promouvoir des mécanismes qui aboutissent, à tous les coups et d’une façon très sévère, à ce résultat. Mais, d’une part, la personne soupçonnée peut être innocente et, d’autre part − et même si elle est coupable − certains procédés sont inadmissibles dans le cadre d’un État civilisé. Le problème fondamental de la procédure pénale est donc de chercher la voie d’un équilibre satisfaisant entre l’intérêt de la collectivité au châtiment raisonnable des coupables et l’intérêt de l’individu poursuivi, coupable ou non, de pouvoir se défendre. C’est ce qui explique les incessants débats dont la matière fait l’objet depuis deux siècles, les quelque cent réformes plus ou moins conséquentes déjà apportées à un Code qui ne date que de 1958 et les projets de réforme pratiquement toujours en cours d’élaboration ou de discussion.
