Bc it further enacted, That every chairman shall annually renew his official bond, and on failure so to do, shall be liable to a penalty of fifty dollars, to be recovered in any court of record in the county in which he lives, on motion of the general superintendent of common schools, whose certificate shall be prima facie evidence in the case; and the committee of finance of each county in the State, and in case there is no such committee, the clerk of the county court, in giving certificates as'to the correctness of the annual report of the chairman, shall also certify whether his bond has been renewed according to the provisions of this act.
