The administrative state is the nexus of American policy making in the postwar period. The vague and sometimes conflicting policy mandates of Congress, the president, and courts are translated into real public policy in the bureaucracy. As the role of the national government has expanded, the national legislature and executive have increasingly delegated authority to administrative agencies to make fundamental policy decisions. How this administrative state is designed, its coherence, its responsiveness, and its efficacy determine, in Robert Dahl’s phrase, “who gets what, when, and how.” This study of agency design, thus, has implications for the study of politics in many areas. The structure of bureaucracies can determine the degree to which political actors can change the direction of agency policy. Politicians frequently attempt to lock their policy preferences into place through insulating structures that are mandated by statute or executive decree. This insulation of public bureaucracies such as the National Transportation Safety Board, the Federal Election Commission, and the National Nuclear Security Administration, is essential to understanding both administrative policy outputs and executive-legislative politics in the United States. This book explains why, when, and how political actors create administrative agencies in such a way as to insulate them from political control, particularly presidential control.

Proposals for power-sharing constitutions remain controversial, as highlighted by current debates in Iraq, Afghanistan, Nepal, and Sudan. This book updates and refines the theory of consociationalism, taking account of the flood of contemporary innovations in power-sharing institutions that have occurred worldwide. The book classifies and compares four types of political institutions: the electoral system, parliamentary or presidential executives, unitary or federal states, and the structure and independence of the mass media. The study tests the potential advantages and disadvantages of each of these institutions for democratic governance. Cross-national time-series data concerning trends in democracy are analyzed for all countries worldwide since the early 1970s. Chapters are enriched by comparing detailed case studies. The mixed-method research design illuminates the underlying causal mechanisms by examining historical developments and processes of institutional change within particular nations and regions. As many formerly authoritarian regimes have been replaced by democratic governments in Latin America, Eastern Europe, and elsewhere, questions have arisen about the stability and durability of these new governments. One concern has to do with the institutional arrangements for governing bequeathed to the new democratic regimes by their authoritarian predecessors and with the related issue of whether presidential or parliamentary systems work better for the consolidation of democracy. In this book, Peter Siavelis takes a close look at the important case of Chile, which had a long tradition of successful legislative resolution of conflict but was left by the Pinochet regime with a changed institutional framework that greatly strengthened the presidency at the expense of the legislature. Weakening of the legislature combined with an exclusionary electoral system, Siavelis argues, undermines the ability of Chile's National Congress to play its former role as an arena of accommodation, creating serious obstacles to interbranch cooperation and, ultimately, democratic governability. Unlike other studies that contrast presidential and parliamentary systems in the large, Siavelis examines a variety of factors, including socioeconomic conditions and characteristics of political parties, that affect whether or not one of these systems will operate more or less successfully at any given time. He also offers proposals for institutional reform that could mitigate the harm he expects the current political structure to produce.
