Human trafficking is a serious crime with grave human rights implicatoins. States are obliged to protect victims as part of their international obligations under the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (Trafficking in Persons Protocol) and other international instruments, including international human rights conventions, and regional commitments. Victim protection is also a cornerstone of an effective criminal justice response to the crime; unless victims of trafficking are appropriately protected, they will not be empowered to support criminal justice action against traffickers.

The United States needs overarching federal guidance on witness protection for human trafficking victims/witnesses in order to enhance their safety and participation in prosecuting their traffickers. The international response predicates itself on a victim-centered approach that works along four distinct efforts to combat the problem: Prevention; Protection; Prosecution; and Partnership. Protection of victims is essential for all victims regardless of their cooperation in anti-trafficking efforts, namely trafficker prosecution. Protection comes in two forms, access to social services and physical protection from human traffickers. A prosecutor's ability to secure vital testimony at trial - increasing the likelihood of conviction - was interrelated to the victim witness receiving protection. Federal guidelines for other components of the fight against trafficking, such as the provision of social services, mirror international advice and practices and are clearly outlined, allowing state and local governments to formulate effective policies in providing support to victims of trafficking. As a result, state and local governments vary in their approach to the physical protection of human trafficking victim witnesses. The thesis argues that victim witness cooperation is improved when victims receive aid and protection and that offering even minimal physical protection increases the likelihood of witness cooperation. Chapter 2 provides a summary of the current frameworks developed by various levels of government to combat human trafficking. The UN and the U.S., as leading authorities, afford similar guidance in most respects. Literature is also reviewed, as pertains to case management and witness protection systems and their place in the global response to human trafficking. Chapter 3 describes the qualitative methodology used to set the stage, analyze research, and deduce meaning to answer the primary thesis question. Chapter 4 offers an analysis of UN, U.S., Colorado, and Denver witness protection guidance and the impact on subordinate levels of government. A secondary analysis of protection provided by NGO case management and witness protection systems articulates the strengths and weaknesses of each. In Chapter 5, recommendations for changes to U.S. witness protection guidance and future topics of research are proposed to generate thoughtful consideration by decision makers and others interested in the human trafficking problem. Sweden and the U.S. have each taken leading roles in the global fight against trafficking in persons. The American approach emphasizes strengthening legal codes and law enforcement tools while enhancing services to victims, and has led to a victim-centered approach. The Swedish model criminalizes demand for trafficking and handling the ¿supply¿ through more admin. means, and has led to an equality-centered approach. Both countries believe sex trafficking is an international issue that requires a mixture of law enforcement, social welfare and foreign policies to solve. This report compares the responses in the U.S. and Sweden to identify synergies and divergences that might impact practice in both countries. Illustrations.

Commercial sexual exploitation and sex trafficking of minors in the United States are frequently overlooked, misunderstood, and unaddressed domestic problems. In the past decade, they have received increasing attention from advocates, the media, academics, and policy makers. However, much of this attention has focused internationally. This international focus has overshadowed the reality that commercial sexual exploitation and sex trafficking of minors also occur every day within the United States. Commercial sexual exploitation and sex trafficking of minors not only are illegal activities, but also result in immediate and long-term physical, mental, and emotional harm to victims and survivors. A nation that is unaware of these problems or disengaged from solving them unwittingly contributes to the ongoing abuse of minors and all but ensures that these crimes will remain marginalized and misunderstood. The 2013 Institute of Medicine and the National Research Council report Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States increases awareness and understanding of the crucial problem of commercial sexual exploitation and sex trafficking of minors in the United States. By examining emerging strategies for preventing and identifying these crimes, for assisting and supporting victims and survivors, and for addressing exploiters and traffickers, that report offers a path forward through recommendations designed to increase awareness and understanding and to support efforts to prevent, identify, and respond to these crimes. Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States: A Guide for Providers of Victim and Support Services offers a more concise and focused perspective on the problem and emerging solutions for providers of victim and support services for children and adolescents. These service providers include policy makers, leaders, practitioners, organizations, and programs at the local, state, and federal levels. This guide will be a valuable resource for them, and for child welfare and child protective services, other agencies and programs within the state and federal governments (e.g., the U.S. Department of Justice's Office for Victims of Crime), and nongovernmental organizations.
