Excerpt from A Treatise on the Law of Personal Property The object of the present edition has been two-fold, namely. To eliminate entirely from the original work so much of its text as is inapplicable in the United States, and to supply, instead, a fur ther presentation, upon the latest authorities, English and American, of the law of the subjects treated of in the retained text, together With that of sundry topics of importance not therein discussed. The few notes which have been retained are, as indicated by the initials G. W, the work of the learned editors of the last edition of Williams on Personal Property, Messrs. Gerhard and Wetherill, of the Philadelphia bar. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from Benjamin's Treatise on the Law of Sale of Personal Property With References to the American Decisions, Vol. 1 of 2 It is believed that the foregoing summary includes mos: of the topics under the law of sale, on which the American and the English courts disagree and it will be observed that there is high American authority to be found in accord with the English decisions on many of these points. On the whole, considering the wide range of the Subject, the differences are remarkably few. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from A Treatise on the Law of Sale of Personal Property, Vol. 1 of 2 The present work was projected in 1887 and something was then done upon it. It was, however, temporarily laid aside for other tasks, until January, 1892. Since that time it has been constantly in hand and has been prosecuted as rapidly as health and the pressure of many other duties would permit. Not withstanding the utmost effort, however, it has been delayed long beyond the time originally fixed for its completion. As it is, the book is very far from being what the writer hoped to make it, or what he still believes he might have made it, had his work been done under more favorable conditions. To retain it longer, however, for further elaboration seems neither practicable nor wise. The general outline and arrangement of Mr. Benjamin have, in the main, been adopted. This course was decided upon for two reasons: first, because Mr. Benjamin's classification has always been regarded as excellent in itself; but secondly and chiefly, because Mr. Benjamin's analysis (which in its turn was largely that of Lord Blackburn) has so decidedly controlled the development of our law in many important particulars, that to attempt a new classification or nomenclature would be confusing if not presumptuous. Mr. Benjamin's text, more over, has been freely drawn upon for statements of the Eng lish law. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Law of Mortgages, Real and Personal Property, Vol. 1 of 2 There are few titles in the law, of higher importance in the United States, than that of Mortgage. With the increase and extension of population, intercourse, and trade, and the consequent enlarged connection of individuals in the relation of creditor and debtor, the cases in which real or personal estate is conditionally transferred, as security for debt, become indefinitely multiplied. The explanation of this fact is found in the consideration, that both creditor and debtor generally prefer a conditional to an absolute transfer; the former, because he seeks payment of his debt, not an acquisition of property; and the latter, because he may thus postpone a pressing claim, and at the same time avoid a sacrifice of his estate. Not only has the transaction in question become a very frequent one, but the relations which it involves or induces are peculiarly various and complicated; leading to nice and difficult questions, which constantly require an appeal to legal tribunals for their settlement. An absolute transfer of property wholly divests the grantor of his title, and vests in the grantee the same simple and unqualified ownership. Excerpt from The Modern Law of Personal Property The present work is intended to be the complement of the Modern Law of Real Property; in consequence of the favor able reception accorded to that work the Author has been induced to undertake this one. The same method has been adopted in particular, where it has appeared desirable, statutes have been quoted verbatim, and in like manner expositions of the lau7 by Judges and Writers are given in their own words. What is common both to realty and to personalty and has been already treated of in the earlier work has not been repeated in this. The subjects of Bankruptcy and of Bills of Sale have been fully treated separate chapters have been devoted to the Bills of Exchange Act, to the Patents, Designs, and Trade Marks Act, and to the laws of Copyright; in the seventh, eighth, and twelfth Chapters will be found an outline of the law relating to Companies the provisions of the Married Women's Property Act, which has effected so many changes, will be found passim. Excerpt from Select Cases and Other Authorities on the Law of Property, Vol. 1 Further, the reading of these cases, it should be remembered, is intended to be accompanied by oral instruction, and therefore they are without the comments which would, on so difficult a subject, be desirable, if the cases were meant for solitary study. As any one will find who attempts to compile a collection of cases, it is hard to make it small enough. I have tried to limit myself to the leading and illustrative authorities, and in the few notes no attempt has been made at a full collection of the decisions, - indeed, no case is ever referred to without a distinct reason for calling attention to it. A special difficulty in dealing with the law of property, and particularly of real property, is to determine how much to dwell on parts of the law which have now become practically obsolete. No two persons would probably decide this question in exactly the same way. I have endeavored to bear in mind, on the one hand, that a real knowledge of the law as it is, requires a knowledge of the law as it has been; and, on the other, that I am working for men who are preparing themselves to be lawyers, and not merely for students of the history of institutions. For the parts of the law of which he treats and for which it was impossible or undesirable to give cases, I have had recourse to the terse and exact sentences of Littleton. I desire especially to acknowledge the aid I have received from Mr. Leake's Digest of the Law of Land. This excellent book (unfortunately not finished) has met with less appreciation than it deserves. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
