In a democracy that for over 200 years has prided itself on public participation and citizen involvement in government, thousands have been and will be the targets of multi-million-dollar lawsuits. They will be sued for such "all-American" activities as circulating a petition, writing a letter to the editor, testifying at a public hearing, reporting violations of the law, filing an official complaint, lobbying for legislation, or otherwise communicating their views. Such cases, named "Strategic Lawsuits Against Public Participation," with their apropos acronym, SLAPPs, are a shocking abuse of one of our most basic political rights - the Right to Petition. So extensive and grievous is the phenomenon that Justice Nicholas Colabella remarked, "Short of a gun to the head, a greater threat to First Amendment expression can scarcely be imagined."George W. Pring and Penelope Canan explore the full range of SLAPP stories in this first study of SLAPPs - retaliatory lawsuits by real estate developers; teachers; police; politicians; opponents of civil rights; consumers' rights; women's rights; and many others. This comprehensive book examines what happens to the targets of SLAPPs and what is happening to public participation in American politics. Addressing the ultimate dilemma - what can be done to turn the tables and fight back - Pring and Canan offer concrete, well-supported, balanced solutions for preventing, managing, and curing SLAPPs at all levels of government. Author note: George W. Pring is Professor of Law at the University of Denver. >P>Penelope Canan is Associate Professor of Sociology at the University of Denver. They are the co-directors of the Political Litigation Project at the University of Denver.

The words we use to talk about justice have an enormous impact on our everyday lives. As the first in-depth, ethnographic study of language, Talking Criminal Justice examines the speech of moral entrepreneurs to illustrate how our justice language encourages social control and punishment. This book highlights how public discourse leaders (from both conservative and liberal sides) guide us toward justice solutions that do not align with our collectively professed value of "equal justice for all" through their language habits. This contextualized study of our justice language demonstrates the concealment of intentions with clever language use which mask justice ideologies that differ greatly from our widely espoused justice values. By the evidence of our own words Talking Criminal Justice shows that we consistently permit and encourage the construction of people in ways which attribute motives that elicit and empower social control and punishment responses, and that make punitive public policy options acceptable. This book will be of interest to academics, students and professionals concerned with social and criminal justice, language, rhetoric and critical criminology.

A blindfolded woman holding a balance and a sword personifies one of our most significant virtues. We find Lady Justice in statues and paintings that adorn courts and other institutions of law, symbolizing strength and impartiality. Yet why do we valorize this virtue primarily as a quality of societies, and secondly as one of individual character? We can trace the virtue of justice to ancient Greece, where virtue ethics began its long evolution. There justice was seen as one of the most prominent virtues - and arguably the most important of the social virtues. With time, political philosophy diverted focus to understanding justice as a property of societies, and discussion of justice as a virtue of individuals diminished. But justice as a virtue of individual character has, along with the other virtues, reasserted itself not only in philosophy but in social psychology and other empirical fields of study. This volume aims to demonstrate the breadth of that thinking and research. It comprises new essays solicited from philosophers and political theorists, psychologists, economists, biologists, and legal scholars. Each contribution focuses on some aspect of what makes people just, either by examining the science that explains the development of justice as a virtue, by highlighting virtue cultivation within distinctive traditions of empirical or philosophical thought, or by adopting a distinctive perspective on justice as an individual trait. As the volume shows, justice begins with the individual, and flows outward to make just laws and just societies.
