This handbook is a practical aid to legislative drafting that brings together, for the first time, model texts of provisions covering all aspects of nuclear law in a consolidated form. Organized along the same lines as the Handbook on Nuclear Law, published by the IAEA in 2003, and containing updated material on new legal developments, this publication represents an important companion resource for the development of new or revised nuclear legislation, as well as for instruction in the fundamentals of nuclear law. It will be particularly useful for those Member States embarking on new or expanding existing nuclear programmes.

Concerns have grown that terrorists could use radioactive materials and sealed sources (materials sealed in a capsule) to build a ¿dirty bomb¿ -- a device using conventional explosives to disperse radioactive material. In 2003, it was found that there were weaknesses in the NRC radioactive materials licensing process and recommend. were made for improvement. This report assesses: (1) the progress NRC has made in implementing the recommend.; (2) other steps NRC has taken to improve its ability to track radioactive materials; (3) Customs and Border Protection¿s (CBP) ability to detect radioactive materials at land ports of entry; and (4) CBP¿s ability to verify that such materials are appropriately licensed prior to entering the U.S. Illustrations.

The NRC has the regulatory responsibility to ensure that the nation¿s 103 commercial nuclear power plants are operated in a safe and secure manner. Safety issues have arisen that threaten the credibility of NRC¿s regulation and oversight. The terrorist attacks on 9/11 focused attention on the security of commercial nuclear power plants, while safety concerns were heightened by shutdown of the Davis-Besse nuclear power plant in 2002, and the discovery of missing or unaccounted for spent nuclear fuel at 3 nuclear power plants. This testimony: summarizes audit findings as of 2005 and recommend. for improving NRC activities; and presents challenges NRC faces in being an effective and credible regulator of the nuclear power industry. Illustrations.

The Nuclear Regulatory Comm. (NRC) regulates domestic medical, industrial, & research uses of sealed radioactive sources. Those attempting to purchase a sealed source must apply for a license & gain the approval of either NRC or an "agreement state (AS)." To become an AS, a state must demonstrate that its regulatory program is compatible with NRC reg's. & is effective in protecting public health & safety. NRC then transfers portions of its authority to the AS. In 2003, it was reported that weaknesses in NRC's licensing program could allow terrorists to obtain radioactive materials. NRC responded to this issue, incl. issuing guidance to license examiners. This report tests the licensing program using covert investigative methods.

Radioactive sources are widely used in the fields of medicine, industry, agriculture, research and education, as well as having military applications. This guide sets out a risk-based ranking of radioactive sources and practices into five categories, in line with IAEA standards, by which risk informed decisions can be made in a graded approach to the regulatory control of radioactive sources for the purposes of safety and security.

With the dissolution of the Soviet Union the nuclear threats facing the world are constantly evolving and have grown more complex since the end of the Cold War. The diversion of complete weapon systems or nuclear material to rogue nations and terrorist organizations has increased. The events of the past years have proved the necessity to reevaluate these threats on a level never before considered. In recognition that no single country possesses all of the answers to the critical scientific, institutional and legal questions associated with combating nuclear and radiological terrorism, the NATO Advanced Research Workshop on “Preparedness for Nuclear and Radiological Threats” and this proceeding was structured to promote wide-ranging, multi-national exploration of critical technology needs and underlying scientific challenges to reducing the threat of nuclear/radiological terrorism; to illustrate through country-specific presentations how resulting technologies were used in national programs; and to outline the role of legal, policy and institutional frameworks in countering nuclear/ radiological terrorism. One key outcome of this book is better understanding of the interdependent contributions from across the international community of the scientific and technological components and the legal, policy and institutional components to combating nuclear and radiological threats.
