Excerpt from Natural Law in the Business World IN presenting this little volume to the public, the writer makes no claim to any new dis coveries, or original theories in the domain of Political Economy; -nor has he any ambition to enter into philosophical or theoretical specula tions. An honest effort to trace out the work ing and application of Natural Law, as it runs through the economic and social fabric, in a plain and simple; though it is hoped practical manner; is all that is attempted. Economic works by theorists and special ists have been multiplied to such an extent, that it seems almost presumptuous for one who has had only a practical business training to venture into a field already so thoroughly ex plored. It is, however, the belief of the writer, that in a great majority of recent works, the sure, continuous, and unerring operation of certain fixed principles, and their resultant effects, has been greatly overlooked or ignored, and sentimental and impractical theories have been substituted for them, 'such a variety of new plans, radical changes, and reforms have been proposed, in order to improve existing conditions, that the world must be re-made in order to give them an op portunity to be tried. Excerpt from Natural Economic Law About thirty years ago I accidentally stumbled upon one of the most important truths in the world of science; the key to natural law in the social and economic world; the key to natural laws that control the growth of civilization. To unlock the door of science with the key was a work of research into millions of facts, - a work almost without end. Systems of finance and political economy have been built around a false premise, and no matter how logically a writer may have reasoned he could not arrive at a right conclusion from his false starting point, no progress was made in unraveling industrial problems, or in abolishing a slavery of labor since the time of Aristotle. The thinking world has been chasing solutions of labor and capital, money and wealth, for centuries, only to see one nation after another rise to wealth and power, to fall in ruin and barbarism. Taking a wrong starting point we travel ever so far and in any direction, but never at any right conclusion; such has been the case with our social and industrial problems. Excerpt from Studies in History, Economics, and Public Law, Vol. 79 The definitions given to the term unemployment by the various authorities cited vary widely, some using it to cover merely the involuntary idleness of able-bodied workers, others cloaking under it all idleness, whatso ever its cause or nature. The limiting extent to which certain authorities apply the term is indicated in the con sideration of their theories. Throughout this paper, how ever, unless otherwise noted, the term is used in a broad sense; in the writer's opinion the vagrant and other types of unemployables are legitimate elements of theproblem of unemployment, even though the social or industrial cause be one step further removed than in the case of the temporarily unemployed wage earner. Excerpt from Economics and Jurisprudence, Vol. 2: An Address It is with no thought of subjecting to analysis any abstruse doctrine of political economy, or of discussing any legal question as a lawyer might discuss it, that I invite your attention for the few moments I have the honor to address you, to a consideration of the relation between Economics and Jurisprudence. My purpose, though less comprehensive, is more definite. Convinced as I am that much of the confusion in economic theory and much of the discord in industrial life, are alike due to inadequate expression by formal law of fundamental in dustrial rights, I desire to point out, as well as I may, the Character of that confusion and discord, and to sug gest the line along which evolution in jurisprudence must proceed in order that harmony in economic theory and peace in the business world may be established. The Natural Law

The Natural Law

Total Pages: 0
Release: 1998
Genre: Law
ISBN: 9780865971615

Originally published in German in 1936, The Natural Law is the first work to clarify the differences between traditional natural law as represented in the writings of Cicero, Aquinas, and Hooker and the revolutionary doctrines of natural rights espoused by Hobbes, Locke, and Rousseau. Beginning with the legacies of Greek and Roman life and thought, Rommen traces the natural law tradition to its displacement by legal positivism and concludes with what the author calls "the reappearance" of natural law thought in more recent times. In seven chapters each Rommen explores "The History of the Idea of Natural Law" and "The Philosophy and Content of the Natural Law." In his introduction, Russell Hittinger places Rommen's work in the context of contemporary debate on the relevance of natural law to philosophical inquiry and constitutional interpretation. Heinrich Rommen (1897–1967) taught in Germany and England before concluding his distinguished scholarly career at Georgetown University. Russell Hittinger is William K. Warren Professor of Catholic Studies and Research Professor of Law at the University of Tulsa.

Excerpt from Economic Cycles: Their Law and Cause There is a considerable unanimity of opinion among experts that, from the purely economic point of view, the most general and characteristic phenomenon of a changing society is the ebb and flow of economic life, the alternation of energetic, buoyant activity with a spiritless, depressed and uncertain drifting. During the creative period of the rhythmic change each factor in production receives an augmenting income, and the mutual adjustment of interests in the productive process is brought about in a natural way, primarily through the operation of competitive law. The period of decline in the cycle presents a sharply contrasted aspect of industry. With the organization of capital and labor at first unchanged, the amount of the product falls; each of the interested factors seeks at least to retain its absolute share of the product; friction and strife ensue with a threatening of the disruption of industry. What is the cause of this alternation of periods of activity and depression? What is its law? These are the fundamental problems of economic dynamics the solution of which is offered in this Essay.
