This unique two-volume work seeks for the first time to address in a comprehensive fashion both "substantive" and "procedural" aspects of international criminal law as applied by international and national courts. Substantive topics include individual criminal responsibility, genocide, war crimes, crimes against humanity, crimes against UN and associated personnel, core crimes and defenses, while procedural aspects include the right of suspects and accused, the protection of victims and witnesses, and pre-trial, trial and appeal procedures and practices. In addressing these subjects the work focuses on the practical application of the relevant norms and provides both detailed commentaries by experts in the field "(Commentary volume)," as well as the underlying documentation for each of the topics addressed "(Documents and Cases volume)," With the establishment of the International Criminal Court, the experiences of other international courts, notably the ad hoc tribunals for the former Yugoslavia and Rwanda as well as their predecessors, in addressing these issues are of great value and this work is intended to assist practitioners and scholars alike. Additionally, because national courts still have a vital role to play in the application of these norms, attention is given to prosecutions in national jurisdictions. With this work the editors seek both to assist the reader in understanding these important concepts as well as to provide the background documentation such that the reader can conduct his or her own research and come to his or her own conclusions.

Volume V Part II of the comprehensive and authoritative Germany and the Second World War series spans the years 1942 to 1945, and looks in closely researched detail, and against a background of growing military setbacks and disasters leading to final defeat, at the administration and ruthless exploitation of the occupied countries and of Germany's own allies, and the effect on their populations (in particular their Jews, Roma, and Sinti) and national economies. This comprehensive study of the meteoric rise to prominence of Hitler's crown prince Albert Speer, and his struggle to implement a 'total war' armaments policy in the face of opposition from the Party's Gauleiters and political rivals in the Nazi leadership, documents with a wealth of maps, diagrams, and tables the achievements of the arms drive he masterminded; a large part of this success is shown to have relied on the forced or slave labour of those under German domination. The conflicting claims of industry and the Wehrmacht for dwindling manpower resources are also considered.

German policy in occupied France during the Second World War was in many ways a story of bitter internal conflict between the various German agencies in charge of the occupation. After the Fall provides a detailed analysis of the struggle between these different agencies, highlighting the significant differences in ideology, policy, and method between the army, the SS, and the diplomatic service, and the rivalries between them in their struggle for dominance. It also looks at what these battles implied for the direction of German policy in France, from the exploitation of the French economy and the suppression of resistance activity, to the attempt to carry out Nazi racial plans. In the process, it sheds much light on both the inner workings of the Nazi regime and on the decisions made by the French government during the course of the occupation.

Enforced disappearance is one of the most serious human rights violations. It constitutes an autonomous offence and a crime under international law on account of its multiple and continuing character. It is not a phenomenon of the past, nor is it geographically limited to Latin America: such scourge is widespread today and on the increase in other continents. For more than twenty-five years, relatives of disappeared people worldwide have insisted on the pressing need for an international legally binding instrument against enforced disappearances. 2006 is the year of the adoption of the International Convention on the Protection of All Persons from Enforced Disappearances, which represents the result of several legislative and jurisprudential developments that are duly analyzed in this book. The Convention has been opened for signature in February 2007.
