Excerpt from Montgomery County Law Reporter, 1888, Vol. 3 The first section of the act of May 14, 1874, P. L. 160, was not intended for the appointment of a commission to inquire into the insanity of a prisoner under sentence of death in order to stay the execution of his sentence; but solely to enable the court to remove an i111] sane prisoner to an asylum for treatment; which was not the prayer of the petition in t is case. The court having no jurisdiction to stay the execution of a death sentence, the appeal should be made to the Governor, who has the power to appoint a commission to inquire into the facts and to act upon their report.
