Release: 2017-10-19
Genre: Law
ISBN: 9780265510766

Excerpt from A Manual of American Mining Law This latest work on American mining law, by Mr. Ricketts, brings everything on the subject up to date, as to State and Federal legislation, the decisions of the courts, and the rulings of the Departments. On reading the advance sheets one is at once struck by the conciseness in which the facts are presented. There has been no attempt whatever toward elaboration or argument. The author gives what he considers the proper construction of the law and in each case cites the authorities. There is there fore nothing to confuse the layman, while at the same time the book is of great value for reference to those of the legal profession. Under each general heading are numbered and titled paragraphs, exceedingly brief but showing the authority and its source. No arrangement could well be handier for reference to the prospector, miner, mine manager or lawyer. It is to be noted that both the first book on American mining law and the latest one on the same subject are by Californian authors, practicing attorneys in the city of San Francisco, where both books were published. The wide demand for the information contained in these bulletins has led the bureau to decide to issue similar bulletins with sufficient frequency to keep reasonably current the records of decisions of Federal and State courts of last resort on questions relating to the mineral industry. The bureau will gladly welcome and consider any suggestions looking to improvement in the matter contained in these bulle tins or the manner in which it is presented. The purpose of the bulletins will continue to be to improve directly or indirectly mining conditions and to promote the health and safety of miners by the prompt publication of decisions, and to this end it is desired that the bulletins reach all persons who are interested. ISBN: 9781331295839

Excerpt from Wilson's Mining Laws: United States, Arizona, California, Nevada and Utah; Annotated, With Forms and Corporation Laws of Arizona; Revised to July 1, 1909 All mineral lands are open to occupation and purchase by any citizen, or he who has declared his intention to become a citizen of the United States. A mining claim located since May 10, 1872, shall not exceed fifteen hundred feet in length along the vein or lode and three hundred feet on each side of the middle of the vein at the surface. The locator of a mining claim has the exclusive right of possession and enjoyment of all of the surface of his claim and of all veins, lodes or ledges throughout their entire depth, the top or apex of which lies inside his surface lines extended vertically downwards. The owner of a mining claim may follow his ledge should its dip carry him beyond his side lines extended vertically down, so long as he does not trespass on the surface of another claim; but in no case can he go beyond his end lines, which must in all cases be parallel. No lode claim can be recorded until a vein or lode has been discovered thereon. Where two claims cross each other the prior location is entitled to all the ore or mineral within the space of intersection, but the subsequent location has a right of way through the space of intersection for the working of the mine, and where two or more veins unite the oldest location takes the vein below the point of union, including all the space of intersection. A Patent can be obtained on a mining claim after $500 has been expended thereon for development or improvement, upon its being surveyed by a United States mineral surveyor, and by the payment of $5 per acre for the land to the United States Government. To Hold An Unpatented Mining Claim, not less than $100 worth of labor shall be performed or improvements made thereon each year, subject to the local laws of the State or rules of the mining district. Where several claims are held in common and are contiguous, the whole expenditure may be made on any one claim. The period within which this work is required to be done begins on the first day of January of the year succeeding the year of location. Excerpt from Handbook on American Mining Law The title American Mining Law has been chosen because of its simplicity and because the law chiefly dealt with, while it affects only a comparatively small part of the United States and its possessions, is so national in its character as deservedly to be spoken of by all writers on the subject as American Mining Law. In the notes the cases which for one reason or another are sug gested as best for students to consult are printed in large type. As is true of other Hornbooks, an exhaustive citation of cases has not been attempted, but the endeavor has been to give a comprehensive, well proportioned, and up-to-date treatment of the subject.
