This book explains how the rule of law emerges and how it survives in nascent democracies. The question of how nascent democracies construct and fortify the rule of law is fundamentally about power. By focusing on judicial autonomy, a key component of the rule of law, this book demonstrates that the fragmentation of political power is a necessary condition for the rule of law. In particular, it shows how party competition sets the stage for independent courts. Using case studies of Argentina at the national level and of two neighboring Argentine provinces, San Luis and Mendoza, this book also addresses patterns of power in the economic and societal realms. The distribution of economic resources among members of a divided elite fosters competitive politics and is therefore one path to the requisite political fragmentation. Where institutional power and economic power converge, a reform coalition of civil society actors can overcome monopolies in the political realm.

Although Juan Domingo Perón's central role in Argentine history and the need for an unbiased assessment of his impact on his nation's cinema are beyond dispute, the existing scholarship on the subject is limited. In recent decades Argentina has witnessed a revival of serious film study, some of which has focused on the nation's classical movies and, in one case, on Peronism. None of this work has been translated into English, however.This is the first English-language book that offers an extensive assessment of Argentine cinema during first Peronism. It is also the first study in any language that concentrates systematically on the evolution of social attitudes reflected in Argentine movies throughout those years and that assesses the period's impact on subsequent filmmaking activity. By analyzing popular Argentine movies from this time through the prism of myth-second-order communication systems that present historically developed customs and attitudes as natural-the book traces the filmic construction of gender, criminality, race, the family, sports, and the military. It identifies in movies the development and evolution of mindsets and attitudes that may be construed as "Peronist." By framing its consideration of films from the Perón years in the context of earlier and later ones, it demonstrates that this period accelerates-and sometimes registers backward-looking responses to-earlier progressive mythic shifts, and it traces the development in the 1950s of a critical mindset that comes to fruition in the "new cinema" of the 1960s. Argentina lies at the heart of the American hemisphere's history of global migration booms of the mid-nineteenth to early twentieth century: by 1910, one of every three Argentine residents was an immigrant—twice the demographic impact that the United States experienced in the boom period. In this context, some one hundred and forty thousand Ottoman Syrians came to Argentina prior to World War I, and over the following decades Middle Eastern communities, institutions, and businesses dotted the landscape of Argentina from bustling Buenos Aires to Argentina's most remote frontiers. Argentina in the Global Middle East connects modern Latin American and Middle Eastern history through their shared links to global migration systems. By following the mobile lives of individuals with roots in the Levantine Middle East, Lily Pearl Balloffet sheds light on the intersections of ethnicity, migrant–homeland ties, and international relations. This book analyses the punitive crime discourse in the Argentinean press during the 1990s. Fernandez Roich focusses on several features of media discourse during this time, such as: the notion that petty criminals ‘deserve to die' in reference to police brutality and killings, the phenomenon of ‘vindicators’ or how common citizens turned into ‘evil’ modern heroes in the press, and the parallelism between the military discourse under the military regime and the punitive discourse under democracy. In addition, the book also investigates the alleged natural propensity towards breaking the law ingrained within Argentinean culture, the so-called 'viveza criolla' and the well-ingrained idea that to get ahead you have to participate in corrupt practices. Despite the significant scholarly interest in the United States and Europe in the last Argentinean dictatorship (1976-1983), little attention has been paid to the role of Argentinean newspapers in supporting the military coup d’état. The analysis of this media discourse is critical to understanding the support enjoyed by the armed forces in power: the vast majority of the population was not informed about the disappearances or the concentration camps until well into the 1980s. This project provides an in-depth qualitative content analysis of front pages, chronicles, editorials and photographs of Argentinean newspapers before and after the military intervention that will aid scholars of criminal justice and Latin American political regimes understand the impact of the support given to the military government.
