In this report the Political and Constitutional Reform Committee gives its assessment of the process of government formation following the May 2010 general election. In general, the committee finds that the process went well, but it also suggests some practical improvements and clarifications. Among the key findings is that clearer guidance is still needed on the circumstances under which a Prime Minister should resign and when he has a duty to remain in office. The report also proposes enhanced processes for ensuring that governments understand-and are discouraged from breaching-restrictions on their activity that apply before and immediately after general elections. The committee concludes that as a coalition government's programme for government cannot be put directly to the people, the House of Commons needs to have the opportunity to subject these proposals to full pre-legislative scrutiny.

The Political and Constitutional Reform Select Committee was established in June 2010 to consider political and constitutional reform. Over the last five years the Committee has scrutinised the Government's substantial programme of political and constitutional reform - which included fixing the term of a Parliament, bringing forward proposals for recalling MPs, establishing a register of third party lobbyists and implementing Individual Electoral Registration. This public engagement is one of it's greatest innovations, and something which it encourages other committees to adopt in the future

Parliaments and Government Formation explores the role of national legislatures in shaping government formation in parliamentary regimes. Under parliamentarism, the government comes from, and remains responsible to, the national parliament. Yet, although legislatures and the politics of government formation are two of the most studied phenomenon in comparative politics, relatively little attention has focused on the degree to which parliamentary rules and procedures impact government formation. For instance, exactly what does 'come from parliament' mean in the context of government formation? To answer this question, the volume seeks to 'unpack' the parliamentary investiture vote. Investiture consists of a vote in parliament to demonstrate that an already formed or about to be formed government has legislative support. The volume analyses investiture along six dimensions: (1) the number of chambers involved in government formation, (2) the exact topic of any investiture vote - for example whether the votes focuses on one or more of the prime ministership, the cabinet and/or the government's policy program, (3) the sequencing and timing of the vote in the overall game of government formation, (4) the decision rule - for example absolute majority, simple or some form of negative parliamentarism, (5) the number of rounds provided for, and (6) what happens in the event of a failure to invest a government. Each of the 16 case studies, written by leading scholars of legislative politics in their respective polities, seeks to describe the institutional rules and practices and analyse their origins and consequences. These case studies are supplemented with two comparative chapters.

This book examines the formation and operation of the Conservative and Liberal Democrat coalition government from May 2010 to May 2015. The authors outline the factors that enabled the union, including economic circumstances, parliamentary politics, the initially amicable relationship established between David Cameron and Nick Clegg, and the apparent ideological closeness of Conservative modernisers and Orange Book Liberal Democrats. Opinion polling has consistently indicated the likelihood of an election result with no overall majority. This means it is likely there will be a negotiation period for the formation of a potential coalition Government or a Government supported on a confidence and supply arrangement. This inquiry was to provide guidance to the public on what to expect in the government formation process in a Parliament with no overall majority. The key issues are that: the negotiation period in 2015 is likely to be longer than in 2010; a Prime Minister who is unlikely to be able to form a new administration is nevertheless likely to remain in office until it is clear that another administration can form a Government which can command the confidence of the House of Commons; if there is no parliamentary majority to support the current administration, it will nevertheless continue in office on a caretaker basis until a new government is formed. The Committee believes it is wrong that Parliament may not have its first meeting after the election until after a new administration has been appointed. They consider that it is wrong in principle that the decision on the date of Parliament's return should be in the hands of the Prime Minister, and recommend that the date of Parliament's first meeting after a General Election should be put on a statutory basis. Parliament should return as soon as possible, and in any case the Prime Minister should set the date for Parliament's return following the General Election for Monday 11 May 2015.
