Le régime de ces deux contrats est proche. En effet, les règles de la vente d’immeuble à rénover, issues de la loi ENL du 13 juillet 2006, sont directement inspirées des dispositions de la vente en l’état futur d’achèvement. Pour cette raison, plutôt que d’effectuer un examen successif de ces contrats, il a été choisi de les examiner simultanément, mettant ainsi en exergue tant leurs ressemblances que leurs différences.
