Comment la participation des enfants et des parents aux procédures devant les autorités de protection de l'enfance est-elle ancrée dans la loi ? Cette analyse retrace l'évolution de cette participation en Suisse depuis l'entrée en vigueur du Code civil en 1912 jusqu'à aujourd'hui, à la lumière du droit suisse, de la Convention des Nations unies relative aux droits de l'enfant et du droit comparé. Ce projet, financé par le FNS dans le cadre du PNR 76, fait partie d'une étude interdisciplinaire et empirique intitulée "Intégrité, autonomie et participation dans la protection de l'enfant : Comment les enfants et les parents vivent-ils les actions des autorités de protection de l'enfant ?" L'analyse chronologique permet d'identifier les obstacles à la mise en œuvre de cette participation en Suisse, ainsi que les facteurs favorisant son développement. Elle met en évidence des améliorations significatives grâce aux instruments de protection des droits de l'homme, mais révèle également une persistance des obstacles systémiques à la participation des personnes concernées, depuis près d'un siècle. Ces résultats soulignent la nécessité d'une loi de procédure unifiée pour la protection de l'enfance, dont les grandes lignes sont exposées dans les conclusions de l'étude.

This book deals with the implementation of the rights of the child as enshrined in the Convention on the Rights of the Child in 21 countries from Europe, Asia, Australia, and the USA.
