La rencontre de l'enfant avec le monde de la Justice peut s'avérer fort délicate. L'enfant ne devrait jamais avoir à fréquenter les prétoires. Pourtant cette confrontation est parfois incontournable, lorsque les parents ne parviennent à régler seuls un litige concernant leur enfant, lorsqu'il est nécessaire de protéger un mineur en danger, ou encore lorsqu'il s'agit de modifier la filiation ou l'identité d'un mineur. En raison de sa vulnérabilité, de son inexpérience et de sa difficulté à saisir les enjeux, le mineur a longtemps été considéré comme un simple objet de droit, qui ne pouvait se faire entendre en justice que par la voix d'un représentant. Toutefois, le droit français a progressivement repensé le statut du mineur, faisant de lui un véritable sujet de droit, malgré son incapacité. La loi du 5 mars 2007 réformant la protection de l'enfance a consacré un droit du mineur doué de discernement à être entendu dans toute procédure civile le concernant. Bien que tardive, cette évolution est la bienvenue au regard des prescriptions de la Convention internationale des droits de l'enfant du 20 novembre 1989. Il est néanmoins regrettable que le législateur ne se soit que très peu préoccupé des modalités de mise œuvre de son droit par le mineur. Les quelques précisions apportées par le décret du 20 mai 2009 apparaissent en effet laconiques et insuffisantes, de sorte qu'il est nécessaire d'imaginer le cadre dans lequel pourront être entendus les mineurs dans le procès civil. Il apparaît que l'audition en justice du mineur doit répondre à deux impératifs a priori contradictoires, bien qu'ils concourent chacun à la recherche de l'intérêt de l'enfant : il s'agit à la fois de protéger l'enfant, qui demeure une personne potentiellement vulnérable, et de protéger sa parole, tout en permettant au mineur de participer à la prise des décisions qui le concernent, pour qu'il puisse conquérir son autonomie décisionnelle.
