Indonesia's political and governmental structures underwent sweeping reforms in the late 1990s. After decades of authoritarian rule, a key aspect of the transition to constitutional democracy during this period was the amendment of the 1945 Indonesian Constitution - an important legal text governing the world's third largest democracy. The amended Constitution introduced profound changes to the legal and political system, including an emphasis on judicial independence, a bill of rights, and the establishment of a Constitutional Court. This volume, with chapters written by leading experts, explores the ongoing debates over the meaning, implementation, and practice of constitutional democracy in Indonesia. This includes debates over the powers of the legislature, the role of the military, the scope of decentralisation, the protection of rights and permissible limits on rights, the regulation of elections, the watchdog role of accountability agencies, and the leading role of the Constitutional Court. These legal issues are analysed in light of the contemporary social, political, and economic environment that has seen a decline in tolerance, freedom, and respect for minorities. Contributions to this volume review the past two decades of reform in Indonesia and assess the challenges to the future of constitutional democracy amidst the wide-spread consensus on the decline of democracy in Indonesia. Demands for amendments to the Constitution and calls to revert to its initial form would be a reversal of Indonesia's democratic gains.

Until the mid-1950s nearly all the waters lying between the far-flung islands of the Indonesian archipelago were as open to the ships of all nations as the waters of the great oceans. In order to enhance its failing sovereign grasp over the nation, as well as to deter perceived external threats to Indonesia’s national integrity, in 1957 the Indonesian government declared that it had “absolute sovereignty” over all the waters lying within straight baselines drawn between the outermost islands of Indonesia. At a single step, Indonesia had asserted its dominion over a vast swathe of what had hitherto been seas open to all, and made its lands and the seas it now claimed a single unified entity for the first time. International outrage and alarm ensued, expressed especially by the great maritime nations. Nevertheless, despite its low international profile, its relative poverty, and its often frail state capacity, Indonesia eventually succeeded in gaining international recognition for its claim when, in 1982, the United Nations Convention on the Law of the Sea formally recognized the existence of a new category of states known as “archipelagic states” and declared that these states had sovereignty over their “archipelagic waters”. Sovereignty and the Sea explains how Indonesia succeeded in its extraordinary claim. At the heart of Indonesia’s archipelagic campaign was a small group of Indonesian diplomats. Largely because of their dogged persistence, negotiating skills, and willingness to make difficult compromises Indonesia became the greatest archipelagic state in the world.

This is an open access book. The 3rd Universitas Lampung International Conference on Social Sciences (ULICoSS) 2022 (ULICoSS) 2022 is an international conference organized by the Institute for Research and Community Services, Universitas Lampung, Indonesia. The event took place on 6th – 7th September 2022 in Bandar Lampung City, on the Indonesian island of Sumatra. This event will adopt a hybrid working model, combining an in-person event with an online meeting via Zoom. Attendees and presenters are expected to interact in this way, using technology to connect to global networks. As has been widely stated in the literature, a number of reports and papers have examined the pandemic’s negative effects, with the majority of work to date focusing on COVID-19’s negative impact on psychological well-being. Thus, social adjustment is required for resilience in order to adapt to and change in the face of adversity. In other words, it is clear that social adjustment, which includes the specific behaviors and abilities that people use to deal with daily problems and adapt to changing circumstances, is critical for global resilience today. As such, this international conference, which will feature five invited keynote speakers from the Czech Republic, Hungary, Indonesia, and Japan is intended to serve as a forum for the dissemination of specific alternative and significant breakthroughs in rapid social adjustments for global resilience, with an emphasis on global society, social welfare and development, and innovative communication, among other topics. Therefore, we invite scholars, academics, researchers, experts, practitioners, and university students to participate and share perspectives, experiences, and research findings by submitting papers on a variety of topics relevant to the conference’s theme and scope. Illiberal Democracy in Indonesia charts the origins and development of organicist ideologies in Indonesia from the early 20th century to the present. In doing so, it provides a background to the theories and ideology that informed organicist thought, traces key themes in Indonesian history, examines the Soeharto regime and his ‘New Order’ in detail, and looks at contemporary Indonesia to question the possibility of past ideologies making a resurgence in the country. Beginning with an exploration of the origins of the theory of the organic state in Europe, this book explores how this influenced many young Indonesian scholars and ‘secular’ nationalists. It also looks in detail at the case of Japan, and identifies the parallels between the process by which Japanese and Indonesian nationalist scholars drew on European romantic organicist ideas to forge ‘anti-Western’ national identities and ideologies. The book then turns to Indonesia’s tumultuous history from the revolution to 1965, the rise of Soeharto, and how his regime used organicist ideology, together with law and terror, to shape the political landscape consolidate control. In turn, it shows how the social and economic changes wrought by the government’s policies, such as the rise of a cosmopolitan middle class and a rapidly growing urban proletariat led to the failure of the corporatist political infrastructure and the eventual collapse of the New Order in 1998. Finally, the epilogue surveys the post Soeharto years to 2014, and how growing disquiet about the inability of the government to contain religious intolerance, violence and corruption, has led to an increased readiness to re-embrace not only more authoritarian styles of rule but also ideological formulas from the past. This book will be welcomed by students and scholars of Southeast Asia, politics and political theory, as well as by those interested in authoritarian regimes, democracy and human rights.
