Depuis plusieurs années, la question de l’opportunité de la justice réparatrice appliquée à l’agression sexuelle fait couler des flots d’encre. Si la criminologie s’y est beaucoup intéressée, le domaine du droit, particulièrement celui de la pénologie, un peu moins. Dans l’intention de mettre de l’avant la parole des victimes et de faire résonner leurs besoins, nous envisageons la voie de la justice réparatrice pour sanctionner le crime d’agression sexuelle au Canada. Nous commençons par justifier la pertinence d’une telle avenue en présentant les préoccupations théoriques touchant la justice réparatrice en relation avec l’agression sexuelle. Ensuite, nous présentons quatre peines (l’absolution, la probation, l’ordonnance de dédommagement et l’emprisonnement avec sursis) que nous appliquons à l’agression sexuelle en les illustrant d’exemples jurisprudentiels récents.

Sexual Assault in Canada is the first English-language book in almost two decades to assess the state of sexual assault law and legal practice in Canada. Gathering together feminist scholars, lawyers, activists and policy-makers, it presents a picture of the difficult issues that Canadian women face when reporting and prosecuting sexual violence.
