Cuando hablamos de educación es relativamente fácil apreciar la relación que en todo proceso educativo se efectúa entre los alumnos menores de edad, sus padres y los profesores y demás autoridades del colegio.Sin embargo, no es tan habitual ser conscientes de que esta relación queda también marcada por la tarea que el legislador debe llevar a cabo para garantizar el derecho a la educación de los menores. Lo habitual es reconocer la implicación del legislador cuando éste ha cruzado la línea divisoria entre el servicio público y la intrusión pública, lo cual puede suceder a la hora de establecer las asignaturas que obligatoriamente deben cursar los alumnos dentro de los planes de estudio. Por ello, si a la difícil tarea de legislar sobre una materia tan elemental y cercana a los ciudadanos como es la educación, incluimos la enseñanza concreta sobre la educación afectivo-sexual, el respeto al derecho de libertad religiosa y de conciencia, y el derecho de los padres a escoger la educación que estimen conveniente para sus hijos, se presenta como un gran reto. Partiendo de esta premisa, esta obra analiza desde la perspectiva legislativa y jurisprudencial, la enseñanza de la educación sexual en los sistemas educativos de EEUU, Canadá y España, y los casos que sobre esta materia ha resuelto el Tribunal de Estrasburgo. En concreto, el objeto de estudio se centra en el tratamiento jurídico de la negativa por parte de algunos padres a la enseñanza obligatoria sobre educación sexual, ya que por razón de la materia misma incide no sólo en la formación intelectual de los menores, sino también en su formación religiosa y moral. Algunas de las propuestas curriculares controvertidas se refieren a charlas impartidas en los centros educativos con contenido sexual explícito, la realización de encuestas sobre el comportamiento íntimo de los menores, la puesta a disposición de los alumnos de programas de distribución de métodos anticonceptivos, la enseñanza de las relaciones entre personas del mismo sexo, las normas y reglamentos que posibilitan la exención de los alumnos de los programas de educación sexual (“pin parental”) y la impartición de dicha educación desde la perspectiva ideológica de género.
