Excerpt from The Journal of the Federal Convention of 1787 Analyzed: The Acts and Proceedings Thereof Compared; And Their Precedents Cited; In Evidence of the Making of the Constitution for Interpretation or Construction in the Alternative, According to Either the Federal Plan or the National Plan The charters of the several colonies show the legis lative and executive separate and distinct from each other, from the first settlement of Virginia down to the Revolution, as they were in England during the same period, but the judiciary, whose powers had been exercised by the legislative and executive with resultant oppression of the people, had only recently become separate and distinct from them, and the sep arate and distinct nature of the three powers was the subject of particular solicitude and expression at this period. Thus it is declared in the constitutions of several states framed during the Revolution that the legislative, executive and judiciary should be sepa rate and distinct.1.
