This publication addresses the role of national systems of intellectual property (IP) in the socio-economic development of emerging countries, notably through their impact on innovation. It presents a framework that identifies the key mechanisms that enable IP systems to support emerging countries' innovation and development objectives. This allows country studies to be conducted to identify strengths and weaknesses in the IP system from the perspective of contributions to national innovation performance. It then enables the formulation of concrete policy recommendations, thereby serving the overall objective of strengthening national innovation and growth. The report also discusses two IP country studies conducted for Colombia and Indonesia. These are based on analyses of the national intellectual property systems, drawing on country missions that gathered detailed information and feedback from more than 100 stakeholders on IP-related priorities and bottlenecks. Concrete policy recommendations are provided for both countries.

This work contains 25 new chapters and the 4 surviving chapters have all been revised, where necessary. Indonesia: Law and Society now covers a broad range of legal fields and includes both historical and very up-to-date analyses and views on Indonesian legal issues. It includes work by leading scholars from a wide range of countries. There is still no comparable, English language text in existence.

Introduction Intellectual property rights foster innovation. But if, as it surely does, “intellectual property” means not just intellectual property rules—the law of patents, copyrights, trademarks, designs, trade secrets, and unfair competition—but also intellectual property institutions—the courts, police, regulatory agencies, and collecting soc- ties that administer these rules—what are the respective roles of intellectual property rules and institutions in fostering creativity? And, to what extent do forces outside intellectual property rules and institutions—economics, culture, politics, history—also contribute to innovation? Is it possible that these other factors so overwhelm the impact of intellectual property regimes that it is futile to expect adjustments in intellectual property rules and institutions to alter patterns of inno- tion and, ultimately, economic development? It was to address these questions in the most dynamic region of the world today, Asia, that we invited leading country experts to contribute studies that not only summarize the current condition of intellectual property regimes in countries ranging in economic size from Cambodia to Japan, and in population from Laos to China, but that also describe the historical sources of these laws and institutions; the realities of intellectual property enforcement in the marketplace; and the political, economic, educational, and scientific infrastructures that sustain and direct inve- ment in innovative activity. This work constitutes the most comprehensive overview of Indonesian intellectual property law since the substantial legislative changes enacted from 1997 onwards. It offers a detailed overview of the Indonesian law and regulation on copyright law, patent law, trademark law, and unfair competition, and analyses the position of Indonesia with regard to the international conventions for the protection of intellectual property. An introduction on the history and development of the Indonesian legal system provides an excellent context for the understanding of the current legislative framework on intellectual property. The book includes in annex authoritative translations of the main laws covering copyright, patents, and trademarks.
