Excerpt from Archives of Maryland: Proceedings of the Court of Chancery of Maryland, 1669 1679; Court Series (5) The seventeenth century courts Of Maryland, to begin with the highest, were 1) the appellate court of the Governor and Council sitting as the Upper House down through the year 1694, and after this date Sitting separately under the name of the Court of Appeals, (2) the Provincial Court or general law court of the Province, (3) the Court Of Chancery for hearing equity cases, (4) the several county courts, and 5) the manorial or leet courts which functioned on the larger manors. A brief general sketch by the editor Of the development of these courts will be found in the introduction to Volume L of the Archives of Maryland. Since the publication Of the last Provincial Court Proceedings as Volume L of the Archives, there was published in 1933, as the first volume of American Legal Records of the American Historical Association, the Proceedings of the Maryland C ourt of Appeals, 169 5-1729, edited by Judge Carroll T. Bond, Chief Judge of the Maryland Court Of Appeals. This is a study Of the records Of the Court of Appeals for the thirty-five years after the Governor and Council began to meet separately in 169 5 to hear cases on appeal and to keep separate records. The cases heard on appeal by the Governor and Council before 1695 are to be found scattered among the records of the Upper House, and have already been printed in the several volumes of the Archives of Maryland known as the Assembly Proceedings. As a rule the records of these cases heard on appeal before the Governor and Council sitting as the Upper House are reported more briefly than are the cases recorded after 1694 in the Proceedings of the Court Of Appeals. With its origins in the seventeenth century, the Maryland Court of Appeals is one of the oldest in the United States. Located in the middle of the east coast, it was confronted with most of the key legal issues that affected the colonies and early United States. Bond's was the first history of the court from its origins around 1649 to the adoption of the state's current constitution in 1867. A valuable study, it is based almost entirely on primary sources. Bond [1873-1943] was the Chief Justice of the Court from 1924 to the end of his life.

Excerpt: ...observed that in both of the cases jnst mentioned proof was held to be inadmissible, to show, against a plaintzfl" insisting that a deed trut/zfully stated a money consideration, that the consideration was of a different kind. In the present case all of the defendants aver in their answers and testify as witnesses that the deed was not made for a money consideration and the plaintiff tcstifies to the same fact. No exceptions were filed by the defendants to testimony or to the sufficiency of the averments of the bill. Under sec. 36 of Art. 5 of the Code, prohibiting any objections to be made in this Court to the admissibility of evidence or the sufficiency of the averments of a bill unless it shall appear by the record that such objection was made by exceptions filed in the Court below, this Court has repeatedly held that on appeals from Courts of equity, where no exceptions were taken below to the testimony, thecase will be determined according to the evidence whether it corresponds with the allegations of the bill or not. Schroeder v. Loeber, 75 Md. I95; Eng/er v. Garrett, IOO Md. 387; Harwood v. fones, 10 G. &. 419. The appellants also contend that the appellee should be denied the relief for which he asks because his own testimony shows that he had the deed of 1868 from Schaeffer made to his wife in order to defraud his creditors and that he kept the lost deed from his children off of the public records for a similar purpose. The only evidence in the record on that subject is his own and he testified that the suit on his bond, which caused him under the advice of counsel to have the first deed made to his wife, was decided in favor of the defendants and no liability to any creditor arose from that source, and that he paid off...
